Home My WebLink AboutOrdinance - 9087-1987 - Amenidng Zoning Ordinance 7084 Zone Case 2152-D Amend 8657, 8732 Site Plan - 06/25/1987LJM:js First Reading June 25, 1987 Agenda Item #9 Second Reading July 9, 1987 Agenda I tern #11 ORDINANCE NO. 9087 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 2152-0; AMEND ORDINANCE NUMBERS 8657 AND 8732 BY AMENDING THE SITE PLAN ON A TRACT OUT OF SECTION 44, BLOCK A-K, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVID- ING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, safety and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amend- ment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 29-29 of the Code of Ordi- nances, City of Lubbock, Texas, as well as notices provided by Article lOllf, Vernon's Annotated Civil Statutes, and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 2152-0 SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: THAT Ordinance Numbers 8657 and 8732 are hereby amended by amending the site plan on a tract of land out of Section 44, Block A-K, City of Lubbock, Lubbock County, Texas, located at the Southeast corner of 19th Street and Iola Avenue, subject to conditions and being further described as follows: · METES AND BOUNDS DESCRIPTION of a 0.980 acre tract located in the Northeast Quarter of Section 44, Block A-K, Lubbock County, Texas; BEGINNING at a 1/211 iron rod (found) which bears South a distance of 359.77 feet and East a distance of 30.00 feet from the Northwest cor- ner of the Northeast Quarter of Section 44, Block A-K; THENCE North a distance of 52.77 feet to a 1/211 iron rod (found) at a corner of this tract; THENCE N. 04°11'39 11 E. a distance of 150.40 feet to a 1/211 iron rod (found) at a corner of this tract; THENCE North a distance of 76.93 feet to a 1/211 iron rod (found) for _a point of curvature; THENCE Northeasterly, around a curve to the right, said curve having a radius of 15.00 feet, a central angle of 90°04', a chord distance of 21.23 feet, and tangent lengths of 15.02 feet to a 1/211 iron rod (found) for a corner of this tract; THENCE S. 89°56' E. a distance of 125.31 feet to a 1/211 iron rod (set) for a corner of this tract; THENCE South a distance of 294.55 feet to a 1/211 iron rod (set) for a corner of this tract; THENCE West a distance of 151.33 feet to the POINT OF BEGINNING. ' SUBJECT TO THE FOLLOWING CONDITIONS: a. That development shall be tied to the site plan presented which includes a curb cut onto 19th Street; and b. That the North 145 feet of the existing screening fence may be removed. SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed One Thousand and No/100 Dollars ($1,000.00) as provided in Section 29-31 of the Zoning Ordi- , nance of the City of Lubbock. SECTION 3. THAT should any paragraph, sentence, clause, phrase or 1. word of this Ordinance be declared unconstitutional or invalid for any rea- son, the remainder of this Ordinance shall not be affected thereby.
