LARGE MAINS MAY BE PARTIALLY PAID BY CITY; AMENDING SECTION 34-63 PROVIDING
FOR REFUNDS; AMENDING SECTION 34-65; PROVIDING FOR UNIT PRICES USED IN CALCULATING
COST OF EXTENSIONS; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS, the City Council has determined that the changes in Article I
and Article II of Chapter 34 of the Code of Ordinances of the City of Lubbock
as shown below are in the best interest of all citizens of the City of Lubbock:
NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Section 34-19 of the Code of Ordinances of the City of
Lubbock BE and is hereby amended in its entirety to read as follows:
"Sec. 34-19 ownership and repair of meters.
All meters installed after the enactment of this ordinance shall be
the property of the City of Lubbock and will be maintained by the City.
The temporary water service meters for construction purposes (one and
one-fourth inch and larger) will remain the property of the owner and
shall be maintained at the owner's expense."
SECTION 2. THAT Section 34-52 of the Code of Ordinances of the City of
Lubbock BE and is hereby amended in part by amending sub-paragraphs (a) and
(b) and the next to last paragraph thereof, relating to charges, to read as
follows:
"(a) 6.50 per front foot of lot or tract of land to which sewer service
is to be provided; and
(b) 6.75 per front foot of lot or tract of land to which water service
is provided; and as more specifically provided herein."

"WHERE lots or tract are irregular in size or shape, then pro-rata charges
shall be based upon equivalent rectangular lots or tracts using (1) front foot
for each (120) square feet of area or the average frontage of such lots or
tracts whichever is les·.s .• 11
SECTION 3. THAT Section 34-58 of the Code of Ordinances of the City of
Lubbock, BE and is hereby amended in its entirety to read as follows:
"Sec. 34-58 Cost of large mains may be partially paid by the City.
When the utility plan of the City requires the extension of a line
larger than that determined by the Engineer as adequate to serve the pro-
perty on which the pro-rata is paid or to be paid, the City may pay the
cost in excess of that required to serve the property on which the pro-
rata is paid when funds are available. The City will participate only in
the cost of lines larger than (12) inches."

SECTION 4. THAT Section 34-63 of the Code of Ordinances of the City of
.' Lubbock BE and is hereby amended in part by amending the first paragraph
thereof relating to refunds, to read as follows:
"Contracts for refunds as provided herein shall be executed by the
developer and the City Manager. The term of the contract shall be 10
years and the City shall not be liable for refunds after the term of the
contract. No interest shall be paid by the City for any money on which
refunds are due."
The fourth paragraph of said Section 34-63 is amended to read as follows:
"When temporary sewers or facilities are constructed as an expedient
to develop a particular area, or when sewers are constructed which other-
wise are not required in the ultimate plan of development for the sanitary
sewer system, the developer shall bear the total cost without refund and
the value of the temporary sewers or facilities shall not be allowed the
developer towards payment of his pro-rata charges. When there is an
extension made to a temporary service to serve existing structures outside
of the area to be developed, refunds shall be limited to ~ the amount of
pro-rata collected by the City for these extensions."
SECTION 5. THAT Section 34-65 of the Code of Ordinances of the City of
Lubbock, BE and is hereby amended in its entirety to read as follows:
"Sec. 34-65. Unit prices used in calculating costs of extensions.
The following prices shall be used as unit prices in calculating the
costs of extensions of water or sewer mains and appurtenances under the
terms of this article:
"Water Mains and Appurtenances Installed:
(Pipe prices are per linear foot, other prices are per item.)

Paving repair shall be estimated by the City Engineers with the Cost,
thereof to be based on current prices of labor and material.
The unit prices above are inclusive of all items not specifically listed
herein which may be necessary to complete the project, except engineering. The
installation of a tapping valve, or tying to an existing cross or tee fifty
feet (SO') from the nearest valve shall be considered a wet tie-in. All wet
tie-ins shall be made by City forces and shall include flushing and steralizing
all water lines.

SECTION 6. THAT should any section, paragraph, sentence, clause, phrase
or word of this Ordinance be declared unconstitutional or invalid for any
reason, the remainder of this Ordinance shall not be affected thereby.
SECTION 7. THAT the City Secretary is hereby authorized to cause publica-
tion of tHe descriptive caption of this Ordinance as an alternative method
