Memorian Center Addition. - 01/10/1980DGV:cl AN ORDINANCE ABANDONING AND CLOSING THE FOLLOWING PORTIONS OF STREET AND ALLEY, ,BUT RETAINING THE SAME AS UTILITY EASEMENT: AVENUE K BETWEEN 4TH STREET ~AND 6TH STREET, PARTIALLY BOUNDED ON THE WEST BY AVENUE L; 5TH STREET BETWEEN THE WEST RIGHT-OF-WAY LINE OF AVENUE K AND THE EAST RIGHT-OF-WAY LINE OF AVENUE L; AND THE NORTH-SOUTH ALLEY BETWEEN 4TH STREET AND 5TH STREET SEPA- RATING BLOCK 5, ORIGINAL TOWN ADDITION, AND BLOCK 3, MEMORIAL CENTER ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAP OF THE CITY OF LUBBOCK TO INDICATE THE CLOSING AND ABANDON- MENT OF THOSE CERTAIN STREETS AND ALLEYS; PROVIDING A SAVINGS CLAUSE AND PRO- VIDING FOR PUBLICATION. WHEREAS, the City Council finds that the Street and Alley portions herein- after .described are no longer needed for street purposes, but only for utility easement purposes; and WHEREAS, the City Council finds it would be in the public interest to close, vacate and abandon the same for street purposes; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the Street and Alley portions hereinafter set out BE and the same are hereby closed, vacated and abandoned for street purposes, but the same are retained as utility easement by the City of Lubbock, Texas: (a) Avenue K between 4th Street and 6th Street, partially bounded on the west by Avenue L. (b) 5th Street between the west right-of-way line of Avenue K and the east right-of-way line of Avenue L. (c) A north-south alley between 4th Street and 5th Street separating Block 5, Original Town Addition, and Block 3, Memorial Center Addition. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official map of the City of Lubbock to indicate that the Street and Alley portions described in Section 1 hereof have been closed and abandoned, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alter- native method as provided by law.
