LJM:js First Reading May 28, 1987 Agenda Item #12 Second Reading --_ _June 11, 1987 Agenda Item #9 ORDINANCE NO. 9079 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 2411-B; AMEND THE SITE PLAN CONDITION OF ORDINANCE NO. 8625 ON A C-2 ZONED TRACT OUT OF SECTION 11, BLOCK E-2, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. !,, I! WHEREAS, the proposed changes in zoning as hereinafter made have been 'I! duly presented to the Planning and Zoning Commission for its recommendation ,i which was received by the City Council and, after due consideration, the j;I City Council finds that due to changed conditions, it would be expedient and i in the interest of the public health, safety and general welfare to make 1 those proposed changes in zoning; and I 1: WHEREAS, all conditions precedent required by law for a val id amend- 11 ment to the Zoning Ordinance and Map have been fully complied with, as well II as giving notices in compliance with Section 29-29 of the Code of Ordi- 1! nances, City of Lubbock, Texas, as well as notices provided by Article I! lOllf, Vernon's Annotated Civil Statutes, and notice was duly published in 1; the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date :: of the public hearing before the City Council on such proposed amendment, ii and the public hearing according to said notice was duly held in the City 1! Council Chamber of the Municipal Building, Lubbock, Texas, at which time lj persons appeared in support of the proposal; and, after said hearing, it was 1 1 ·.ii, by the City Council determined that it would be in the public interest, due 11 to changed conditions, that the Zoning Ordinance and the Zoning Map be i:l amended in the manner hereinafter set forth in the body of this Ordinance jl and this Ordinance having been introduced prior to first reading hereof; NOW i! THAT Ordinance No. 7084 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: Amend Ordinance No. 8625 by replacing condition "a." of that Ordinance with the following condition, under provisions of Section 29-29 of the Code of Ordinances of the City of Lubbock, on a C-2 zoned tract out of Section 11, Block E-2, City of Lubbock, Lubbock County, Texas, located on the East side of Quaker Avenue from the 7800 to 7900 block, subject to conditions and being further described as follows: II i ! METES AND BOUNDS DESCRIPTION of a 3.204 acre tract located in Section 11, Block E-2, Lubbock County, Texas, being further described as fol- lows: BEGINNING at a point which bears N. 89°59 14011 E. a distance of 75.00 feet and N. 00°02 14611 E. a distance of 584.60 feet from the Southwest corner of Section 11, Block E-2, Lubbock County, Texas; THENCE N. 00°02 14611 E. an approximate distance of 509.52 feet; THENCE N. 89°59 14011 E. an approximate distance of 397.47 feet; THENCE S. 17°01 1 37 11 E. an approximate distance of 92.73 feet; THENCE Southwesterly around a curve to the left, said curve having a radius of 311.00 feet, a central angle of 73°13 15611 , tangent lengths of 231.10 feet and an approximate chord distance of 370.99 feet to a point of intersection; THENCE S. 00°02 1 46 11 W. an approximate distance of 123.19 feet; THENCE S. 89°59 140 11 W. an approximate distance of 203.55 feet to the POINT OF BEGINNING. SUBJECT TO THE FOLLOWING CONDITION: a. A site plan, including building elevations showing materials, color and texture shall be submitted and approved by the Plan- ning and Zoning Commission on the entire tract under this Zoning Ordinance prior to the issuance of a building permit. SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed One Thousand and No/100 Dollars ($1,000.00) as provided in Section 29-31 of the Zoning Ordi- nance of the City of Lubbock. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any rea- son, the remainder of this Ordinance shall not be affected thereby. - 2 - i1' 1:1 !i,i ;,'i iii SECTION 4.
