JWF :js First Reading May 14, 1987 Agenda Item #23 Second Reading May 28, 1987 Agenda Item #7 ORDINANCE NO. 9072 AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS ON CERTAIN PORTIONS OF STATE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION STATE HIGHWAY SPUR NO. 327, AS HEREINAFTER MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS OR- DINANCE; DIRECTING PLACEMENT OF SIGNS WITH RESPECT THERETO; REPEALING CON- FLICTING ORDINANCES TO THE EXTENT OF SUCH CONFLICT; APPLICATION OF THIS OR- DINANCE ONLY TO STREETS OR HIGHWAYS NAMED HEREIN; PROVIDING THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council of the City of Lubbock, upon the basis of an engineering and traffic investigation finds it necessary to alter prima fa- cie speed limits as established by Section 166(A)(l) of Article 67O1d, Ver- non's Annotated Civil Statutes, within the areas and the locations named and designated in the body of this Ordinance, all within the corporate limits of i the City of Lubbock; NOW THEREFORE: i -BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT pursuant to Section 169(8), V.A.C.S., the prima facie speed limits on the following streets and highways in the urban district set forth below are hereby altered and changed as hereinafter set forth upon the following described portions of streets and/or highways located within the City of Lubbock, Lubbock County, Texas, to-wit: On State Department of Highways and Public Transportation State High- way Spur No. 327 the following speed limits: 1. 45 MPH: a. For westbound traffic from a point 1,022 feet East of Frankford Avenue to a point 1,957 feet West of Frankford Avenue. b. For eastbound traffic from a point 1,957 feet West of Frankford Avenue to a point 1,211 feet East of Frankford Avenue. 2. 55 MPH: a. For eastbound traffic from a point 1,211 feet East of Frankford Avenue to State Loop 289. b. For westbound traffic from State Loop 289 to a point 1,022 feet East of Frankford Avenue. c. For eastbound and westbound traffic from a point 1,957 feet West of Frankford Avenue West to the West City limits. SECTION 2. THAT all Ordinances or parts of Ordinances conflicting with any of the provisions hereof are hereby repealed insofar as such con- flict exists. SECTION 3. THAT all highways or streets not specifically set forth in the preceding sections hereof shall not be affected by the provisions here- of, and this Ordinance shall be cumulative of all other prima facie speed limit Ordinances except those with which it specifically conflicts. SECTION 4. THAT the City Manager is hereby authorized and directed to cause the placing and maintenance of such traffic control signals and/or de- vices and/or signs as shall be necessary to apprise the public of the zones as hereinabove set forth. SECTION 5. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed Two Hundred Dollars ($200.00) as provided in Section 1-4 of the City Code. SECTION 6. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any rea- son, the remainder of this Ordinance shall not be affected thereby. SECTION 7. THAT the City Secretary is hereby authorized to cause pub- lication of the descriptive caption and penalty clause of this Ordinance as an alternative method provided by law.
