WHEBF.AS, in Ordinance No. 8166 of the City of LUbbock, Texas, which abandoned and closed two underground utility easements described respec- tively therein as Tracts 1 and 2 there was an error in the legal descrip- tion in Tract 2 which needs to be corrected as a matter of p.Jblic record, said Ordinance No. 8166 being passed on final reading the 14th day of May, 1981; and WHEBF.AS, Resolution No. 796 was passed by the City Council on said same date of May 14, 1981, authorizing the Mayor to execute a quitclaim deed to said two underground utility easemnts as aforesaid in favor of Cilmaron Joint venture Number Four, and said quitclaim deed was made a part of said resolution as spread upon the minutes of the City CoW1Cil, and said quitclaim deed was recorded in Volume 1740, Pages 113-114 ii (inclusive) of the Deed Records of Lubbock County, Texas, reference to I which is hereby made for a pertinent purpose, and said quitclaim con-,i · tained an error in the legal description of Tract 2 (similar to the error H made in Ordinance No. 8166 as aforesaid) which also needs correcting as a !i. matter of p.Jblic record, R:li" THEREFORE: BE I'l' OIDAINED BY THE CI'IY a:mcIL OF THE CIT.Y' OF LOBBO(l{: SEX:TION 1. SOCTION 2. THAT except as hereby amended said Ordinance No. 8166 of the City of LUbbock shall remain the same in all other respects, and as hereby amended is declared to be in full force and effect to affect the corrections as aforesaid. SOCTION 3. THAT the Mayor of the City of LUbbock is hereby autho- rized and directed to execute a Correction Quitclaim Deed in favor of Cimnaron Joint Venture NUuber Four to affect the corrections of the quit- claim deed as aforesaid, attached herewith which shall be spread upon the mirwtes of the Council and as spread upon the mirwtes of this Council shall constitute and be a part of this Ordinance as if fully copied herein in detail. SOCTION 4. THAT the City Secretai:y is hereby authorized and directed to cause the publication of the descriptive caption of this Ordinance as an alternative method of publication as provided by law.
