HomeMy WebLinkAboutOrdinance - 9061-1987 - Amending Zoning Ordinance 7084 Zone Case 2460-D - 04/23/1987LJM:js First Reading April 23, 1987 Agenda Item #14 Second Reading May 14, 1987 Agenda Item #8 ORDINANCE NO. 9061 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 2460-D; A ZONING CHANGE FROM R-1, R-1 SPECIFIC USE, GO AND LIMITED C-2 TO R-1, R-2, GO AND C-2 ZONING ON TRACTS OUT OF SECTION 11, BLOCK E-2, LUBBOCK, TEXAS; SUB- JECT TO CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PRO- VIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, morals, and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amend- ment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 29-29 of the Code of Ordi- nances, City of Lubbock, Texas, as well as notices provided by Article lOllf, Vernon's Annotated Civil Statutes, and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room of the City Hall, Lubbock, Texas, at which time persons ap- peared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THERE- FORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 2460-D SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: A change of zoning from R-1, R-1 Specific use, GO and limited C-2 to R-1, R-2, GO and C-2 zoning districts, under provisions of Section 29- 29 of the Code of Ordinances of the City of Lubbock, on tracts out of Section 11, Block E-2, City of Lubbock, Lubbock County, Texas, located from 82nd Street to Loop 289 and from Quaker Avenue to Memphis Avenue, subject to conditions and being further described as follows: TRACT E METES AND BOUNDS DESCRIPTION of a 1.92 acre tract located in Section 11, Block E-2, Lubbock County, Texas, being further described as fol- lows: BEGINNING at a point which bears North an approximate distance of 2820.00 feet and East an approximate distance of 2486.00 feet from the Southwest corner of Section 11, Block E-2, Lubbock County, Texas; THENCE North an approximate distance of 510.00 feet; THENCE East an approximate distance of 164.00 feet; THENCE South an approximate distance of 510.00 feet; THENCE West an approximate distance of 164.00 feet to the POINT OF BE- GINNING. That Tracts S, BB and CC shall be zoned C-2; and e. That a site plan, including building elevations showing mate- rials, color, and texture, shall be submitted and approved by the Planning and Zoning Commission on each Tract under this Zon- ing Ordinance except Tracts L, V, Zand AA, prior to issuance of a building permit on that Tract. - 8 - SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed One Thousand and No/1OO Dollars ($1,000.00) as provided in Section 29-31(a) of the Zoning Or- dinance of the City of Lubbock. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any rea- son, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause pub- lication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
