HomeMy WebLinkAboutOrdinance - 9052-1987 - Amending Zoning Ordinance 7084 Zone Case 2543-A Riding Stables. - 03/26/1987First Reading Mar ch 26, 1987 Agenda Item# Second Reading April 9, 1987 Agenda Item #6 ORDINANCE NO. 9052 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 2543-A; A ZONING CHANGE FROM R-1 SPECIFIC USE, RESIDENTIAL ESTATES, TO R-1 SPECIFIC USE PERMIT FOR RIDING STABLES ON LOTS 10 AND 15, COLONIAL HEIGHTS ADDITION, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAV- INGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been !( duly presented to the Planning and Zoning Commission for its recommendation II which was received by the City Council and, after due consideration, the !I City Council finds that due to changed conditions, it would be expedient and II ,·n the interest of the public health, morals, and general welfare to make 11 ;1 those proposed changes in zoning; and I I I WHEREAS, all conditions precedent required by law for a valid amend- 1 ment to the Zoning Ordinance and Map have been fully complied with, as well ll as giving notices in compliance with Section 29-29 of the Code of Ordi- 11 nances, City of Lubbock, Texas, as well as notices provided by Article 11 lOllf, Vernon's Annotated Civil Statutes, and notice was duly published in ii the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date I! of the pub 1 i c hearing before the City Council on such proposed amendment, • and the public hearing according to said notice was duly held in the City 1: 11 Council Room of the City Hall, Lubbock, Texas, at which time persons ap-t! l,!!1 peared in support of the proposal; and, after said hearing, it was by the .. City Council determined that it would be in the public interest, due to ! 1 ,II changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this f• Ordinance having been introduced prior to first reading hereof; NOW THERE- f FORE: I ! THAT Ordinance No. 7084 and the Official Zoning Map BE and same are hereby amended as follows, to-wit: A change of zoning from R-1 Specific Use Permit for Residential Es- tates to R-1 Specific Use Permit, under provisions of Section 29-24 (c)(4) of the Code of Ordinances of the City of Lubbock for commercial riding stable$, on Lots 10 and 15, Colonial Heights Addition, City of Lubbock, Lubbock County, Texas, located at 92nd to 94th Streets on the East side of Avenue T, and subject to conditions. SUBJECT TO THE FOLLOWING CONDITIONS: a. That there shall be a parking ratio on this development site of one (1) parking space for every five (5) animals allowed on this site under the Code requirements; and b. That the parking lot shall be of gravel material; and c. That a site plan, including building elevations showing mate- rials, color, and texture, shall be submitted and approved by the Planning and Zoning Commission on the entire tract under this Zoning Ordinance, prior to issuance of a building permit. SECTION 2. THAT the Director of Planning of the City of Lubbock is authorized to issue a Specific Use Permit to the Applicant in said Zone Case in accordance with the recommendations and conditions imposed by the Plan- ning and Zoning Commission, on file with the office of the Director of Plan- ning and the City Council which are hereby adopted and incorporated herein by reference for all purposes, provided said applicant agrees to be bound by the term of the Specific Use Permit, the granting of which is hereby made subject to compliance to all provisions of Zoning Ordinance No. 7084, an Or- dinance of the City of Lubbock, including particularly, but not limited to Section 29-24 of the Codified Zoning Ordinance, which provides that a Spe- cific Use Permit and a Building Permit shall be applied for and secured within thirty (30) months of the effective date of the zone change or all undeveloped property shall automatically revert back to the R-1 Specific Use Permit for Residential Estates; and the Director of Planning in such event is directed to remove from the Zoning Map the legend indicating commercial riding stables. The Specific Use authorized by this Ordinance is permitted under provision of Section 29-24(c)(4) of Codified Zoning Ordinance No. 7084 on the property described as Lots 10 and 15, Colonial Heights Addition, City of Lubbock, Lubbock County, Texas. SECTION 3. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed One Thousand and No/100 Dollars ($1,000.00) as provided in Section 29-31(a) of the Zoning Or- dinance of the City of Lubbock. SECTION 4. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any rea- son, the remainder of this Ordinance shall not be affected thereby. - 2 - SECTION 5. THAT the City Secretary is hereby authorized to cause pub- lication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
