Home My WebLink AboutOrdinance - 9047-1987 - Closing Underground Utility Easement Lakeridge Country Club Estates - 03/26/19871, ocu.-f .. ,,.,... !' - 1 10586 File And Return To Ed Bucy R·O•W First Reading March 12, 1987 Agenda J..tx•p.JJ.5 VOL f-40~ PAGE Second Reading March 26, 1987 Item #6 ORDINANCE NO. 9047 AN ORDINANCE ABANDONING AND CLOSING AN UNDERGROUND UTILITY EASEMENT LOCATED IN LOT 499, LAKERIDGE COUNTRY CLUB ESTATES ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, AN UNDERGROUND UTILITY EASEMENT LOCATED IN LOT 500, LAKERIDGE COUNTRY CLUB ESTATES ADDITION, AND A TRANSFORMER PAD EASEMENT LOCATED IN LOT 500, LAKERIDGE COUNTRY CLUB ESTATES ADDITION, EACH OF WHICH IS MORE PARTICULARLY DESCRIBED HEREINAFTER IN THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the underground utility easements and transformer pad easement as hereinafter described in the body of this Ordinance are no longer needed for public use and it would be in the public interest to close, vacate and abandon the same; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the underground utility easements and transformer pad easement as hereinafter described in three tracts shall BE and the same are hereby closed, vacated and abandoned for easement purposes and for public use; TRACT 1 A 5-foot underground utility easement located on the North part of Lot 499, Lakeridge Country Club Estates Addition to the City of Lubbock, Lubbock County, Texas, being further described as follows: BEGINNING at the Northwest corner of Lot 499, Lakeridge Country Club Estates Addition to the City of Lubbock, Lubbock County, Texas; THENCE N. 86°02 1 19 11 E., along the North line of said Lot 499, a distance of 119.59 feet; THENCE S. 02°57 1 55 11 E. a distance of 5.00 feet; THENCE S. 86°02 1 19 11 W. a distance of 119.87 feet; THENCE Northerly around a curve to the left, said curve having a radius of 1173.74 feet, a central angle of 00°14 141 11 , a chord distance of 5.01 feet and a chord bearing of N. 00°16 13011 E. to the POINT OF BEGINNING. 64 ( __ _ VOL 2485 PAGE 65 TRACT 2 A 5-foot underground utility easement located on the South part of Lot 500, Lakeridge Country Club Estates Addition to the City of Lubbock, Lubbock County, Texas, being further described as follows: BEGINNING at the Southwest corner of Lot 500, Lakeridge Country Club Estates Addition to the City of Lubbock, Lubbock County, Texas; THENCE Northerly around a curve to the left, said curve having a radius of 1173.74 feet, a central angle of 00°14 14111 , a chord distance of 5.01 feet and a chord bearing of N. 00°05 132" W.; THENCE N. 86°02 1 19" E. a distance of 119.33 feet; THENCE S. 02°57 1 55" E. a distance of 5.00 feet to a point in the South line of said Lot 500; THENCE S. 86°02 119" W., along the South line of said Lot 500, a distance of 119.59 feet to the POINT OF BEGINNING. TRACT 3 A transformer pad easement located on the South part of Lot 500, Lakeridge Country Club Estates Addition to the City of Lubbock, Lubbock County, Texas, being further described as follows: BEGINNING at a point which bears S. 86°02 1 19" W., 10.00 feet from the Southeast corner of Lot 500, Lakeridge Country Club Estates Addition to the City of Lubbock, Lubbock County, Texas; THENCE S. 86°02'1911 W., along the South line of said Lot 500, a distance of 4.00 feet; THENCE N. 02°57'5511 W. a distance of 6.00 feet; THENCE N. 86°02'19" E. a distance of 4.00 feet; THENCE S. 02°57 1 55 11 E. a distance of 6.00 feet to the POINT OF BEGINNING. SECTION 2. THAT the City Engineer shall mark said abandoning and closing on the official maps of the City, giving the number of the Ordinance and the date of final passage. -2- _,. ...... THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
