ORDINANCE NO. 9040
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 ANO THE OFFICIAL MAP
OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 2191-A; A
ZONING CHANGE FROM R-1, R-2, A-1 ANO C-3 to R-1, R-2 ANO C-3 ZONING ANO C-4
ZONING, LIMITED TO CERTAIN LISTED USES ON THE SOUTHWEST QUARTER OF SECTION
9, BLOCK J-S, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDING A PENALTY;
PROVIDING A SAVINGS CLAUSE ANO PROVIDING FOR PUBLICATION.
WHEREAS, the proposed changes in zoning as hereinafter made have been
duly presented to the Planning and Zoning Commission for its recommendation
which was received by the City Council and, after due consideration, the
City Council finds that due to changed conditions, it would be expedient and
in the interest of the public health, morals, and general welfare to make
those proposed changes in zoning; and
WHEREAS, all conditions precedent required by law for a valid amend-
ment to the Zoning Ordinance and Map have been fully complied with, as well
as giving notices in compliance with Section 29-29 of the Code of Ordi-
nances, City of Lubbock, Texas, as well as notices provided by Article
lOllf, Vernon's Annotated Civil Statutes, and notice was duly published in
the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date
of the public hearing before the City Council on such proposed amendment,
and the public hearing according to said notice was duly held in the City
Council Room of the City Hall, Lubbock, Texas, at which time persons ap-
peared in support of the proposal; and, after said hearing, it was by the
City Council determined that it would be in the public interest, due to
changed conditions, that the Zoning Ordinance and the Zoning Map be amended
in the manner hereinafter set forth in the body of this Ordinance and this
Ordinance having been introduced prior to first reading hereof; NOW THERE-
FORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
ZONE CASE NO. 2191-A
SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and
the same are hereby amended as follows, to-wit:
A change of zoning from R-1, R-2, A-1 and C-3 to R-1, R-2 and C-3 zon-
ing districts, and C•4 zoning district, limited to certain listed
uses, under provisions of Section 29-29 of the Code of Ordinances of
the City of Lubbock, on the Southwest quarter of Section 9, Block J-S,
City of Lubbock, Lubbock County, Texas, located North of 19th Street,
East of Milwaukee Avenue, South of 11th Place and West of Iola Avenue,
subject to conditions, and being further described as follows:
TRACT 1
METES AND BOUNDS DESCRIPTION of a 26.26 acre tract located in the
Southwest Quarter of Section 9, Block J-S, Lubbock County, Texas, be-
ing further described as follows:
BEGINNING at a point which bears East an approximate distance of
780.00 feet from the Southwest corner of Section 9, Block J-S, Lubbock
County, Texas;
THENCE North an approximate distance of 615.00 feet;
THENCE East an approximate distance of 1860.00 feet;
THENCE South an approximate distance of 615.00 feet;
THENCE West an approximate distance of 1860.00 feet to the POINT OF
BEGINNING.
TRACT 2
METES AND BOUNDS DESCRIPTION of a 6.36 acre tract located in the
Southwest Quarter of Section 9, Block J-S, Lubbock County, Texas, be-
ing further described as follows:
BEGINNING at the Southwest corner of Section 9, Block J-S, Lubbock
County, Texas;
THENCE North an approximate distance of 355.00 feet;
THENCE East an approximate distance of 780.00 feet;
THENCE South an approximate distance of 355.00 feet;
THENCE West an approximate distance of 780.00 feet to the POINT OF BE-
GINNING.
TRACT 3
METES AND BOUNDS DESCRIPTION of a 12.38 acre tract located in the
Southwest Quarter of Section 9, Block J-S, Lubbock County, Texas, be-
ing further described as follows:
BEGINNING at a point which bears East an approximate distance of
2640.00 feet and North an approximate distance of 615.00 feet from the
Southwest corner of Section 9, Block J-S, Lubbock County, Texas;
THENCE West an approximate distance of 1860.00 feet;
THENCE North an approximate distance of 290.00 feet;
THENCE East an approximate distance of 1860.00 feet;

THENCE South an approximate distance distance of 290.00 feet to the
POINT OF BEGINNING.
TRACT 4
METES AND BOUNDS DESCRIPTION of a 3.24 acre tract located in the
Southwest Quarter of Section 9, Block J-S, Lubbock County, Texas, be-
ing further described as follows:
BEGINNING at a point which bears North an approximate distance of
2640.00 feet from the Southwest corner of Section 9, Block J-S,
Lubbock County, Texas;
THENCE East an approximate distance of 910.00 feet;
THENCE South an approximate distance of 155.00 feet;
THENCE West an approximate distance of 910.00 feet;
THENCE North an approximate distance of 155.00 feet to the POINT OF
BEGINNING.
TRACT 5
METES AND BOUNDS DESCRIPTION of a 111.76 acre tract located in the
Southwest Quarter of Section 9, Block J-S, Lubbock County, Texas, be-
ing further described as follows:
BEGINNING at a point which bears North an approximate distance of
355.00 feet from the Southwest corner of Section 9, Block J-S, Lubbock
County, Texas;
THENCE North an approximate distance of 2130.00 feet;
THENCE East an approximate distance of 910.00 feet;
THENCE North an approximate distance of 155.00 feet;
THENCE East an approximate distance of 1730.00 feet;
THENCE South an approximate distance of 1735.00 feet;
THENCE West an approximate distance of 1860.00 feet;
THENCE South an approximate distance of 550.00 feet;
THENCE West an approximate distance of 780.00 feet to the POINT OF BE-
GINNING.
SUBJECT TO THE FOLLOWING CONDITIONS:
a. That Tract 1 shall be zoned C-4 limited to the following uses:

(1) Agriculture implement and tractor sales and service
(totally within a building);
(2) Automobile body shops, outside storage limited to customer
vehicles only;
(3) Automobile brake shop;
(4) Automobile glass shop;
(5) Automobile seat cover and upholstery shop;
(6) Automobile transmission shop;
(7) Automobile and recreational vehicle sales and service (may
include body and paint shop, as accessory use);
(8) Boat and boat trailer sales and service;
(9) Builders supply. All materials must be in a building;

(17) Uses unconditionally permitted in the C-3 zoning district;
b. Tract 2 shall be zoned C-3;
c. Tracts 3 and 4 shall be zoned R-2;
d. Tract 5 shall be zoned R-1; and
e. That a site plan, including building elevations showing materi-
als, color and texture shall be submitted and approved by the
Planning and Zoning Commission on Tracts 1 and 2 under this Zon-
ing Ordinance prior to the issuance of a building permit.

SECTION 2. THAT violation of any provisions of this Ordinance shall
be deemed a misdemeanor punishable by a fine not to exceed One Thousand and
No/1O0 Dollars ($1,000.00) as provided in Section 29-3l(a) of the Zoning Or-
dinance of the City of Lubbock.
SECTION 3. THAT should any paragraph, sentence, clause, phrase or
word of this Ordinance be declared unconstitutional or invalid for any rea-
son, the remainder of this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary is hereby authorized to cause pub-
lication of the descriptive caption of this Ordinance as an alternative
method provided by law.
AND IT IS SO ORDERED.
