ORDINANCE NO. 6 782
AN ORDINANCE SETTING A 20 MPH SCHOOL ZONE WITH FLASHING
TRAFFIC SIGNALS ON PORTIONS OF ".MEMPHIS AVENUE AS MORE PARTI-
CULARLY DESCRIBED IN SECTION ONE (1) OF THIS ORDINANCE: DIRECTING
THE CITY MANAGER TO CAUSE SIGNS AND TRAFFIC CONTROL SIGNALS TO
BE PLACED: REPEALING ALL ORDINANCES OR PARTS THEREOF WHICH ARE
IN CONFLICT HEREWITH: PROVIDING THAT THIS ORDINANCE SHALL ONLY
AFFECT STREETS SPECIFICALLY SET FORTH HEREIN AND THAT THIS
ORDINANCE IS CUMULATIVE: PROVIDING A SAVINGS CLAUSE: PRESCRIBING
A PENALTY: AND PROVIDING FOR PUBLICATION OF THIS ORDINANCE.
WHEREAS, the governing body of the City of Lubbock, Texas, deems it
in the public interest, safety, health and general welfare, that a certain 20 MPH
school zone should be set up as hereinafter set forth in the body of this
Ordinance to better handle and control vehicular traffic for the safety of the
citizens of the City of Lubbock in general and school children l thereof in
particular; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the prima facie speed limit established by Article
6701D, Section 166 (a)(l), Vernon1s Texas Civil Statutes, is altered and changed
for all vehicles t,G TWENTY (20) miles per hour during the time the flashing
traffic control signals is in operation on the following described highways or
streets in the corporate limits of the City of Lubbock., Lubbock County, Texas.,
to-wit:
A 20 MPH School Speed Zone when the school signal
is flashing on both sides of Memphis A venue beginning
at a point 180 feet North of the center line of 58th Street
and extending South for a distance of 1010 feet.
SECTION 2. THAT the City Manager is authorized and directed to cause
the placing 0f signs and traffic control signals so as to clearly define the limits
of the prima facie areas set out in this Ordinance.
SECTION 3. THAT all Ordinances or parts of Ordinances conflicting
with any of the provisions hereof are hereby repealed insofar as such conflict
exists.
SECTION 4. THAT all highways or streets not specifically set forth
in the preceding section hereof shall not be affected by the provisions hereof,
and this Ordinance shall be cumulative of all other prima facie speed limit
Ordinances except those with which it specifically conflicts.
-S!:CTION 5. THAT should any section, paragraph, sentence.~' clause,
phrase ~r word of this Ordinance be declared unconstitutional or invalid for any
reason, the eemainEler of this Ordinance shall not be affected thereby.
SECTION 6. THAT any person, firm or corporation violating the prima
facie speed limit established by this Ordinance shall, upon conviction., be fined
any sum not to exceed TWO HUNDRED ($200. 00 ) DOLLARS.
SECTION 7. THAT the City Secretary is authorized and directed to cause
the publication of the descriptive caption of this Ordinance together with the
penalty provision as an alternative method of publication as provided by law.
AND IT IS SO ORDERED.
