Agenda Iten #14'0lt.: 9 PAGE192 Second Reading December 15, 1988 Item #9 ORDINANCE NO. 9240 AN ORDINANCE ABANDONING AND CLOSING A PORTION OF A STORM WATER STORAGE AND DRAINAGE EASEMENT LOCATED IN SECTION 11, BLOCK E-2, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY OF LUBBOCK TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the portion of the storm water drainage and storage easement as hereinafter described in the body of this Ordinance is no longer needed for public use and it would be in the public interest to close, vacate and abandon the same; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the portion of the storm water storage and drainage easement as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for easement purposes and for public use; The portion of a storm water storage and drainage easement located in Section 11, Block E-2, being further described as follows: BEGINNING at a point which bears N. 89.59'40" E. 206.00 feet and N. oo•02'46" E. 65.00 feet from the Southwest corner of Section 11, Block E-2, lubbock County, Texas; THENCE N. oo·o2'46" E. a distance of 218.50 feet; THENCE N. 89°59'40" E. a distance of 102.55 feet; THENCE N. oo·o2'46" E. a distance of 146.50 feet; THENCE N. 89°59'40" E. a distance of 781.13 feet; THENCE Northwesterly around a curve to the left, said curve having a radius of 397.32 feet, a central angle of 02.58'47", tangent lengths of 10.33 feet and a chord distance of 20.66 feet; THENCE N. 89.59'40" E. a distance of 465.53 feet; THENCE S. oo·o2'46" w. a distance of 230.00 feet; THENCE S. 89°59'40 11 w. a distance of 150.00 feet; THENCE S. oo·o2'46" w. a distance of 165.00 feet; THENCE S. 89.59'40" w. a distance of 90.00 feet; THENCE N. oo·o2'46" E. a distance of 165.00 feet; -VOL2979 PAGE19:) THENCE S. 89.59'40" w. a distance of 360.00 feet; THENCE S. oo·o2'46" w. a distance of 165.00 feet; THENCE S. 89°59'40" w. a distance of 88.00 feet; THENCE N. oo·o2'46" E. a distance of 165.00 feet; THENCE S. 89.59' 40'' w. a distance of 150.00 feet; THENCE S. oo·o2'46" w. a distance of 165.00 feet; THENCE S. 89.59'40" w. a distance of 199.00 feet; THENCE N. 87.08'35" w. a distance of 200.25 feet; THENCE S. 89.59'40" W. a distance of 107.00 feet to the POINT OF BEGINNING. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
