HomeMy WebLinkAboutOrdinance - 9239-1988 - Amending Section 2-407.2 Terms Office Members - 11/17/1988rev. 11/17/88 DGV:da First Reading November 17~ 1988 Item #t8 Second Reading December 8, 1988 Item #7 ORDINANCE NO. 9239 AN ORDINANCE AMENDING SECTION 2-407.2 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO THE TERMS OF OFFICE OF THE MEMBERS OF THE BOARD OF CITY DEVELOPMENT; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the performance of its duties by the Board of City Development is of the utmost importance to the citizens of the City of lubbock; and WHEREAS, continuity in Board membership is an essential element in the ability of the Board to conduct its affairs in an expeditious and businesslike manner; and WHEREAS, Article 11, Section 11, of the Texas Constitution limits the terms of City board members to two (2) years; and WHEREAS, it is the desire of the City Council of the City of lubbock to provide that members may serve three (3) consecutive two-year terms, rather than the present limitation of two (2) consecutive two-year terms; and WHEREAS, the City Council of the City of Lubbock had originally requested an ordinance that would stagger the terms of the Board in such a manner that no more than five (5) members would be replaced at any one time, but the City Council requested that the provisions of this ordinance staggering the terms be deleted between first and second reading; NOW THEREFORE: BE IT RESOlVED BY THE CITY COUNCil OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 2-407.2 of the Code of Ordinances of the City of lubbock, Texas, BE and is hereby amended to read as follows: Sec. 2-407.2. Term of Office. In accordance with Article 11, Section 11, of the Constitution of the State of Texas, the term of office of the members of the Board of City Development shall be two (2) years except, however, of the members first appointed in accordance with this article, the term of office of seven (7) of the members so appointed shall be for one (1) year only and thereafter all appointments shall carry a two-year term. No member of the Board may serve for more than three (3) consecutive terms. SECTION 2. THAT the above change from two (2) consecutive terms to three (3) consecutive terms shall apply only to those persons appointed to the Board of City Development after final passage of this ordinance. SECTION 3. THAT should any sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method of publication provided by law.
