DGV:js First Reading November 17, 1988 Item #17 Second Reading December 8. 1988 Item #6 ORDINANCE NO. 9238 AN ORDINANCE AMENDING SECTION 28-92 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, IN ITS ENTIRETY SO AS TO CHANGE THE RATES FOR SEWER SERVICE WITHIN THE CITY OF LUBBOCK EFFECTIVE JANUARY 1, 1989; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council is of the opinion and deems it to be in the public interest that sewer service rates be increased as is herein set out in order to provide adequate sewer service for the citizens of the City of Lubbock.; WHEREAS, the City Council's intention is to establish sewer service rates that will adequately cover operational, maintenance and capital costs; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 28-92 of the Code of Ordinances of the City of Lubbock., Texas, BE and is amended to read as follows: 11 (a} Sewer service charges presently in effect under this Section shall remain in effect until January 1, 1989, and effective for all billings scheduled to be rendered on and after January 1, 1989, there shall be charged for sewer service to all residences, places of busi- ~~ ness, private and public buildings, churches, schools, institutions, and all other sewer services customers the following service charges: RESIDENTIAL: Individually Metered Residential $5.60 per month minimum includ- ing 3,000 ga11ons; $0.68 per thousand gallons per month there- after maximum charge $10.36 (10,000 gallons per month} for each non-sprinkler meter. Individually Metered Residential units shall pay the above ser- vice charge based on a calculated estimate of sewer flow deter- mined from water consumption records for individual customers. Water consumption information for months of typically low irri- gation usage will be examined to establish a "basis11 for sewer service charges. Sewer charges will be levied based on water consumption up to the maximum determined by the "basis." The basis for new customers shall be 6,000 gallons until adequate historical information is available. COMMERCIAL: 5/8 inch or 3/4 inch meter $5.60 per month minimum including 3,000 gallons; $0.68 per thousand gallons per months thereafter. 1 and 1 1/4 inch meter 1 1/2 inch meter 2 inch meter 3 inch meter 4 inch meter 6 inch meter 8 inch meter 10 inch meter ,.·' $13.52 per month minimum includ- ing 3,000 gallons; $0.68 per thousand gallons per months thereafter. $24.09 per month minimum includ- ing 3,000 gallons; $0.68 per thousand gallons per months thereafter. $34.66 per month minimum includ- ing 3,000 gallons; $0.68 per thousand gallons per months thereafter. $92.77 per month minimum includ- ing 3,000 gallons; $0.68 per thousand gallons per months thereafter. $161.45 per month minimum includ- ing 3,000 gallons; $0.68 per thousand gallons per months thereafter. $330.50 per month minimum includ- ing 3,000 gallons; $0.68 per thousand gallons per months thereafter. $475.79 per month minimum includ- ing 3,000 gallons; $0.68 per thousand gallons per months thereafter. $766.35 per month minimum includ- , ing 3,000 gallons; $0.68 per thousand gallons per months thereafter. Commercial accounts may be adjusted to exclude in-plant losses. Universities, Schools, Geriatric Institutions, Orphan Homes, Public or Private Institutions, Public Schools, Churches and all other sewer service customers except individually metered residents The charge for these users shall be the same as the commercial rate. and industrial customers. INDUSTRIAL: - 2 - The charge for industrial users shall be the same as Multi-Family Residential (Nonindividually metered Residential Units). the commercial rate; how- ever, industrial waste that exceeds the allowable strength shall be admitted to the sewer only by con- tract with the City. The charge for treating B.O.D. shall be $.1076/lb. and treated S.S. shall be $.0918/lb. The charge for these users shall be the same as the commercial rate. (b) The rates for sewer service as shown in paragraph (a) next- above, shall be reviewed annually to insure the adequacy of the rates to cover the total cost of operation, maintenance, and capital costs. These rates shall be examined by the Assistant City Manager for Finan- cial Services and the Assistant City Manager for Financial Services shall make such recommendations for adjustments and changes in such rates to the City Council as deemed necessary after each annual review for consideration by the City Council." SECTION 2. THAT should any paragraph, section, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 3. THAT the City Secretary is hereby authorized to cause pub- lication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
