B� IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
TH�11' the Mayor of the City of Lubbock is hereby authorized and directed to
execute for and on bchalf of the City of Lubbock, Amendment No. 1 to the professional
services agreement Contract No. 17967 for the design of unpaved road improvements by and
between the City of Lubbock and Kimley-Horn Associates, Inc., and related documents. Said
Amendment is attached hcrcto and incorporated in this resolution as if fully set forth herein
and shall bc included in the minutes of the City Council.

Amendment 1
To Agreement Between
The City of Lubbock, TX
And
Kimley-Horn and Associates, Inc.
THIS IS THE FIRST AMENDMENT TO THE AGREEMENT dated and entered into on the 26th day of
March, 2024, Contract No. 17967, by and between the City of Lubbock ("City") and Kimley-Horn
Associates, Inc. ("Engineer"), collectively (the "Parties").
Engineer is providing professional services for the design of unpaved road improvements (the "Activities").
On March 25, 2025 the Parties executed a six (6) month extension for time only.
The Parties now agree to add to the scope of services Engineer will complete as part of the Activities.
NOW THEREFORE, the Parties enter into this amendment and agree as follows:
The scope of the Activities shall be amended to include additional services for project management, final
design, and franchise utility coordination, the details of which are set forth in "Exhibit A", attached hereto
and incorporated herein. The additional services herein shall be performed by the Engineer for an amount
not to exceed fifteen thousand and 00/100 Dollars ($15,000.00).
All other terms of the Agreement remain the same and are not altered herein.
IN WITNESS HEREOF, the parties have executed this Agreement as of this 22nd day of
July 2025.

EXHIBIT A — Amendment 01
Engineering Scope of Services
Unpaved Street Improvements
City of lubbock
PROJECT UNDERSTANDING
The project consists of providing the following services to supplement the design of the Unpaved
Street Improvements project and is related to Professional Services Contract 17967, dated March
26, 2024 for Engineering Services. This scope of services consists of the following:
• Project Management
• Final Design
• Franchise Utility Coordination
The Engineer shall perform the following Additional Services:
1. Project Management
1.1. Project coordination
1.1.1 Coordination with LAN on proposed intersection tie-in at E 78th Street and M.L.K.
Blvd.
1.1.2 Internal design team meetings to review and discuss revised paving
improvements consisting of:
• Oberlin Street grading modifications
• Avenue T and 96th Street intersection addition and grading modifications
• Intersection design changes along E 78th Street and 94th Street
2. Final Design
2.1. Avenue T Profile Update
2.1.1 Update PGL and gutter profiles through 96th Street and no longer tie-in to
previous City plans
2.1.2 Revise plan and profile sheets
2.2. Avenue T and 96t" Street Intersection
2.2.1 Design fully improved intersection per City direction
2.2.2 Create intersection detail sheet detailing design
2.3. Design Cross Sections
2.3.1 Provide printed design cross sections for each project location
2.4. Deliverables
2.4.1 90% & 99% Submittal
• Submit electronic PDF file of the design to the City for review and comment.
• The Engineer will address one (1) round of review comments in preparation for
final submittal.

3. Franchise Utility Coordination
3.1. Utility Conflicts
3.1.1 Engineer will identify utility conflict locations and provide to City for relocation
coordination
4. Additional Services
Services not specifically identified in the Scope of Services above shall be considered additional
and shall be performed on an individual basis upon authorization by the City. Such services shall
include, but are not limited to, the following:
• Utility relocation coordination
• Right of Way acquisition services
• Construction Contract Administration
• Construction Phase Engineer of Record support services
• Construction Phase RPR Services
• Design of any offsite drainage improvements beyond the improvements identified in the
scope
• Design of structural retaining walls
• Preparation for and attendance at public meetings
• Redesign to reflect project scope changes requested by the City, required to address
changed conditions or change in direction previously approved by the City, mandated by
changing governmental laws, or necessitated by the City's acceptance of substitutions
proposed by the contractor
SCHEDULE
Engineer is authorized to commence work on the Project upon execution of a mutually acceptable
contract and agreed to complete the services in accordance with the schedule outlined in the
Professional Services Contract 17967 for Engineering Services.

The Consultant will perform the services in Tasks 1-3 on a labor fee basis with the maximum labor
fee shown below:

The Engineer will not exceed the total maximum labor fee shown above without authorization from
the City. Individual task amounts are provided for budgeting purposes only. The Engineer reserves
the right to reallocate amounts among tasks as necessary. Labor fee will be billed on an hourly
basis according to our then-current rates. As to these tasks, direct reimbursable expenses such as
express delivery services, fees, travel, and other direct expenses will be billed at 1.15 times cost. A
percentage of Engineer labor fee (4.6%) will be added to each invoice to cover certain other
expenses such as telecommunications, in-house reproduction, postage, supplies, project related
computer time, and local mileage.
