HomeMy WebLinkAboutOrdinance - 9228-1988 - Amending Article XIII Chapter 2 Lubbock Library Boards - 09/08/1988II DGV:dw First Reading September 8, 1988 Item #15 Second Readfmg September 22, 1988 Item #S ORDINANCE NO. 9228 _ __;,.. ____ _ AN ORDINANCE AMENDING ARTICLE XIII OF CHAPTER 2 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO THE COMPOSITION AND MEMBERSHIP OF THE LUBBOCK LIBRARIES BOARD; PROVIDING FOR A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council of the City of Lubbock has determined that it would be in the best interest of the citizens of the City of Lubbock to alter the membership and composition of the Lubbock Libraries Board; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 2-330 of the Code of Ordinances of the City of Lubbock, Texas, BE and is hereby amended to read as follows: "Sec. 2-330. Creation; appointment; terms of members. There is hereby created and established a library board to be composed of seven (7) members, and such board shall be officially designated as the Lubbock Libraries Board. The library director shall be an ex officio member of the library board, without voting privileges, and shall act in an advisory capacity to the board. Six (6} members of such board shall be appointed by the City Council and shall hold their office for a term of three {3) years. Subject to City Council approval, the seventh member of the board shall be each newly elected president of the Friends of the Lubbock City-County Library.11 SECTION 2. THAT Section 2-332 of the Code of Ordinances of the City of Lubbock, Texas, BE and is hereby amended to read as follows: "Sec. 2-332. Chairman and secretary; record of proceedings. The libraries board shall appoint a chairman, a vice-chairman, and a secretary from among its members. It shall be the duty of the chairman to preside at all meetings of the board. The vice-chairman shall assume the duties of the chairman in his absence and perform ·such other duties as are assigned by the board. The secretary shall keep a record of all the proceedings of the board, which record shall, upon the request of the City Council, be delivered to it for its inspection and review.11 II I : i 1·1 SECTION 3. THAT Section 2-334 of the Code of Ordinances of the City :1 of Lubbock, Texas, BE and is hereby amended to read as follows: il :1 11Sec. 2-334. Quorum; voting • . , All recommendations made by the libraries board to the City Council shall be by the concurring vote of five (5) members of the board; provided, however, that this provision shall not exclude a minority recommendation which is hereby authorized to be made in writing by less than a majority of the members of the board. A majority of the total membership of the board shall constitute a quorum for the transaction of all matters to be considered by the board." SECTION 4. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 5. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method of publication provided by law.
