HomeMy WebLinkAboutOrdinance - 9205-1988 - Amending Chapter 29 Amending Section 29-29(C)(3) - 05/12/1988\I BLL:js First Reading May 12!t 1988 Item 11 Se coro Read i ng May 26, 1988 Item 12 ORDINANCE NO. 9205 AN ORDINANCE AMENDING CHAPTER 29 OF THE CODE OF ORDINANCES, CITY OF LUBBOCK, ENTITLED "ZONING," BY AMENDING SECTION 29-29(c)(3) PERTAINING TO CHANGES IN ZONING; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, safety and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amend· ment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 29-29 of the Code of Ordi- nances, City of Lubbock, Texas, as well as notices provided by Section 211.006(a), Texas Local Government Code, and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 29-29(c)(3) of the Code of Ordinances, City of Lubbock, Texas is hereby amended to read as follows: 11(3) If the Planning and Zoning Commission recommends against a pro- posed amendment, supplement, change or modification, or if a proposed amendment, supplement, change or modification is protested in accordance with this subsection, the proposed amendment, supplement, change or modification must receive, in order to take effect, the affirmative vote of at least three- fourths (3/4) of all members of the City Council. The protest must be written and signed by the owners of at least 20 percent of either: a. The area of the lots or land covered by the proposed change; or I! i; j: 'I I i b. The area of the lots or land immediately adjoining the area covered by the proposed change and extending 200 feet from that area. In computing the percentage of land area under this subsection, the area of streets and alleys shall be included ... SECTION 2. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any rea- son, the remainder of this Ordinance shall not be affected thereby. SECTION 3. THAT the City Secretary is hereby authorized to cause pub- lication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
