HomeMy WebLinkAboutOrdinance - 9198-1988 - Amending Chapter 6 Article III Plumbing Code Drain Pan - 04/28/1988BLL:js First Reading April 28, 1988 Item 25 Second Reading May 12, 1988 Item 7 ORDINANCE NO. 9198 AN ORDINANCE AMENDING CHAPTER 6, ARTICLE III OF THE CODE OF ORDI- NANCES, CITY OF LUBBOCK, TEXAS, ENTITLED 11 PLUMBING CODE"; BY ADDING REQUIRE- MENTS FOR DRAIN PANS TO BE PLACED UNDER All WATER HEATERS INSTALLED IN NEW CONSTRUCTION; PROVIDING FOR A PENALTY; PROVIDING A SAVINGS CLAUSE AND PRO- VIDING FOR PUBLICATION. WHEREAS, the proposed amendment to the Plumbing Code has been recom- mended by the Plumbing and Mechanical Board; and WHEREAS, the City Council has found the proposed amendment to be expe- dient and in the interest of the public health, safety and general welfare; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the Code of Ordinances, City of Lubbock, Texas, is hereby amended by adding a section, to be numbered 6-85.33.3, which said section reads as follows: "Sec. 6-85.33.3. Required Drain Pan. Section 1310{e} shall be added to the Uniform Plumbing Code and shall read as follows: {e) All water heaters installed in new construction, except those located where floor drains are provided, shall be equipped with a non-combustible drain pan at least one {1} inch in depth to prevent structure damage should the water heater develop any water leaks. Drain pans shall be properly trapped and connected to the building sewer line or the outside of the structure. Re- placement water heaters previously equipped with drain pans shall continue to be equipped with the drain pans as required for new construction. No other appliance, fixture or drain lines shall discharge into the drain pan." SECTION 2. THAT violation of any provision of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed Two Hundred and No/100 Dollars ($200.00} as provided by Section 6-81.2 of the Code of Ordi- nances, City of lubbock, Texas; SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any rea- son, the remainder of this Ordinance shall not be affected thereby. '' I SECTION 4. THAT the City Secretary is hereby authorized to cause pub- lication of the descriptive caption of this Ordinance as an alternative method provided by law.
