PAiiE 9 Second Reading Apri 1 28, 1988 ORDINANCE NO. 9193 AN ORDINANCE ABANDONING AND CLOSING TWO TRANSFORMER PAD EASEMENTS AND A PORTION OF AN UNDERGROUND UTILITY EASEMENT LOCATED IN RUSHLAND PARK ADDI- TION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, EACH OF WHICH IS MORE PARTICULARLY DESCRIBED HEREINAFTER IN THIS ORDINANCE; DIRECTING THE CITY EN- GINEER TO MARK THE OFFICIAL MAPS OF THE CITY OF LUBBOCK TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUB-LICATION. . WHEREAS, the City Council finds that the transformer pad easements and that portion of the underground utility easement as hereinafter described in the body of this Ordinance are no longer needed for public use and it would be in the public interest to close, vacate and abandon the same; NOW THERE- FORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the transformer pad easements and portion of the un- derground utility easement as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for easement purposes and for pub- 1 i c use: TRACT 1 A 4' x 6' transformer pad easement for Lubbock Power and Light Com- pany, located on Tract H, 15th Installment, Rushland Park Addition to the City of Lubbock, Lubbock County, Texas, being further described as follows: BEGINNING at a point which bears West a distance of 10.00 feet from the Northeast corner of Tract H, 15th Installment, Rushland Park Addi- tion to the City of Lubbock, Lubbock County, Texas; THENCE South a distance of 6.00 feet; THENCE West a distance of 4.00 feet; THENCE North a distance of 6.00 feet; THENCE East a distance of 4.00 feet to the POINT OF BEGINNING. TRACT 2 A 4' x 6' transformer pad easement for Lubbock Power and Light Com- pany, located on Tract B, 15th Installment, Rushland Park Addition to VOl2810 PAGE280 the City of Lubbock, Lubbock County, Texas, being further described as follows: BEGINNING at a point which bears S. 89°49'36" W. a distance of 10.00 feet and South a distance of 5.00 feet from the Northeast corner of Tract B, 15th Installment, Rushland Park Addition to the City of Lubbock, Lubbock County, Texas; THENCE South a distance of 6.00 feet; THENCE S. 89°49'36" W. a distance of 4.00 feet; THENCE North a distance of 6.00 feet; THENCE N. 89°49'36" E. a distance of 4.00 feet to the POINT OF BEGIN-NING. TRACT 3 A portion of a 20-foot underground utility easement located on Tracts B, H, and M, 15th Installment, Rushland Park Addition to the City of Lubbock, Lubbock County, Texas, being further described as follows: BEGINNING at the Northeast corner of Tract B, same being the Northwest corner of Tract M, 15th Installment, Rushland Park Addition to the City of Lubbock, Lubbock County, Texas; THENCE N. 89°49'36" a distance .of 10.00 feet; THENCE South a distance of 298.35 feet; THENCE S. 59°49'36" W. a distance of 23.13 feet; THENCE North a distance of 309.91 feet; THENCE N. 89°49'36" E. a distance of 10.00 feet to the POINT OF BEGIN~ NING. SECTION 2. THAT the City Engineer shall mark .the official maps of the City of Lubbock to indicate said abandoning and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. - 2 - vet2Si0 PA~t281 SECTION 4.
