PAGE 292 ORDINANCE NO. 9172 AN ORDINANCE ABANDONING AND CLOSING A PORTIONS OF 70th STREET LOCATED IN SECTION 5, BLOCK 3, IN THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, riND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING TH£ CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY OF LUBBOCK TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDUJG FOR PUBLICATION. . ,. < WHEREAS, the City Council finds that the street portions hereinafte; described are no longer needed for street purposes and fo.r public use; and WHEREAS, the City Council finds it would be to the public interest to close, vacate and abandon the same for street purposes and for.public use; NOW THEREFORE: '' BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the street portions as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for street purposes and for public use: A portion of 70th Street located in Section 5, Block E, to the City of Lubbock, Lubbock County, Texas, being further described as follows: BEGINNING at a point which bears N. 89°52'38" E. a distance of 2140.90 feet and S. 00°07'22" E. a distance of 1070.00 feet from the Northwest corner of Section 5, Block E to the City of Lubbock, Lubbock County, Texas; THENCE Northeasterly around a curve to the right, said curve having a radius of 50.00 feet, a central angle of 106°15'36", tangent lengths of 66.67 feet, a chord distance of 80.00 feet and chord bearing of N. 89°52 I 3811 E. ; THENCE S. 89°52'38" W. a distance of 80.00 feet to the POINT OF BEGIN- NING. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to indicate said abandon~ ment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. . ..
