ORDINANCE NO. 6 709
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 AND THE
OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWIN
CHANGE: ZONE CASE NO. 1916: CHANGE A TRACT OF LAND OUT OF
SECTION 3, BLOCK E ... 2, LUBBOCK COUNTY, TEXAS, FROM AN "A ... 111 AND
"R-1 11 ZONING DISTRICT TO AN "R .. l SPECIFIC USE., ROW DWELLINGS OR
TOWNHOUSES:" SUBJECT TO CONDITIONS; PROVIDING A SAVINGS CLAUSE
AND PROVIDING FOR A PENALTY AND PROVIDING FOR PUBLICATION.
WHEREAS, after receiving the recommendations of the Planning and Zo-
ning Commission and after due notice and public hearing and all matters having
been done and performed as required by Section 14 .. A of Zoning Ordinance No.
1695 of the City of Lubbock, (said Ordinance being an Appendix to the Lubbock
City Code) relating to Specific Use Permits, the City Council finds that due to
changed conditions, it would be expedient and in the interest of the public health,
morals and general welfare to authorize the granting of a Specific Use Permit
as hereinafter set forth., NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the Director of Planning of the City of Lubbock is
authorized to issue a Specific Use Permit to the Applicant in Zone Case No. 191
in accordance with the recommendations and conditions imposed by the Planning
and Zoning Commission, on file with the office of the Director of Planning, and
the City Council which are hereby adopted and incorporated herein by reference
for all purposes0 provided said Applicant agrees to be bound by the terms of the
Specific Use Permit., the granting of which is hereby made subject to, compliance
to all provisions of Zoning Ordinance No. 1695 an Ordinance of the City of Lub-
bock., including particularly but not limited to, Section 14-A of Zoning Ordinance
No. 1695 within twentyHfour (24) months of the effective date of this Ordinance,
the City Secretary .. Treasurer shall be and is hereby authorized and instructed,
upon written notice from the Director of Planning that Applicant has not complie
with the provisions., conditions and terms imposed by this Ordinance, to note
Applicantts failure to comply on the margin of the Minutes of the City Council
opposite entry of this Ordinance, and the authorization to issue such Specific Use
Permit is hereby revoked; and the Director of Planning in such event is directed
to remove from the Zoning Map the legend indicating such limited use. The
Specific Use authorized by this Ordinance is for Row Dwellings or Townhouses,
under provisions of Section 14-A .... 19, of the Zoning Ordinance on the property
below described.
ZONE CASE NO. 1916
Change a tract of land out of Section 3, Block E .. 2,
Lubbock County, Texas, from an "A-1" and "R ... 1"
Zoning District to an 11R-1 Specific Use. Row Dwel-
lings or Townhouses"; further described by metes
and bounds~ to-wit:

BEGINNING at a 3/811 iron rod set in the South
right ... of-way line of State Farm Road 2255 (West
4th Street} which is South 60. 00 feet and West
1324. 5 feet from the Northeast corner of the said
Section 3 for the Northeast corner of this tract;
THENCE South 747. 76 feet to the point of intersection
of the center line of Salem Avenue and the Nor therly
line of 7th Street;
THENCE N 79 degrees, 24 minutes, 35 seconds W., along
the Northerly line of 7th Street, 42. 98 feet to a point;
THENCE South 56, 97 feet;
THENCE in a Southeasterly direction along the arc of
a circular curve to the right the radius of which is
15. 0 feet, 20. 79 feet t o a point in the West line of
Salem Avenue (the long chord of said curve is S. 50
degrees, 17 minutes, 42 seconds E. 19. 17 feet;
THENCE South along the West line of Salem Avenue,
129. 67 feet to a 3/811 iron rod set at the Northeast
corner of the Thirteenth Installment of Rushland Park
Addition for the Southeast corner of this tract;
THENCE N 72 degrees, 29 minutes, 39 seconds W., along
a Northerly line of the said Thirteenth Installment,
208. 28 feet to a 3/811 iron rod;
THENCE West 1089. 73 feet to a 3/811 iron rod set in
the East line of Toledo Avenue at the Northwest corner
of the said Thirteenth Installment for the Southwest
corner of this tract;
SUBJECT TO THE FOLLOWING CONDITIONS:
1. The site for the .detachable garbage containers, as shown on the
approved site plan, shall be screened from view from adjoining
property.
2. Restrictive covenants covering development of the subject property
shall be rec orded at the time of the recording of the first final
plat.
SECTION 2. THAT from and after passage and effective date of this
Ordinance, said lots., tracts and parcels of land described in Section 1 hereof
shall be changed to the zoning district indicated and the Official Map is amended
in accordance herewith.
SECTION 3. THAT any person., firm or corp:,ration owning or operating
the subject property failing to comply with the conditions imposed by Section 1
hereof shall be guilty of a misdemeanor and upon conviction thereof, shall be
subject to a fine not to exceed TWO HUNDRED DOLLARS and each and every day1
violation thereof shall constitute a separate and distinct offense.
The failure of any corporation owning or operating the subject property to
comply with any of the conditions imposed by Section 1 hereof shall render the
President., Vice-President, General Manager, Local Manager and Local Agent
liable to the penalty prescribed in this Section.
SECTION 4. THAT should any section, paragraph, sentence., clause, phr e
or word of this Ordinance be declared unconstitutional or invalid for any reason, e
remainder of this Ordinance shall not be affected thereby.
SECTION 5. THAT the City Secretary is hereby authorized to cause pub ..
lication of the descriptive caption of this Ordinance as an alternative method pro-
vided by law.
