ORDINANCE AMEl\fDING ORDINANCE NO. 4251 OF THE CITY OF LUBBOCK BY DELETING SUBSECTION 23, SECTION 2 THEREOF SO AS TO REMOVE THE 20 MPH SCHOOL ZONE DESIGNATION FOR A CERTAIN PORTION OF 50TH STREET AS DESCRIBED IN SECTION 1 OF THIS ORDINANC1 ; RE;F>EALING ORDINANCE NO. 5327 OF THE CITY OF LUBBOCK IN ITS EN- TIRETY;· SETTING A 20 MPH SCHOOL ZONE WITH FLASHING TRAFFIC SIG- NALS ON PORTIONS OF AVENUE U AND E AS MORE PARTICULARLY DESCRI ... BED IN SECTION 3 OF THIS ORDINANCE; DIRECTING THE CITY MANAGER TO CAUSE SIGNS AND TRAFFIC CONTROL SIGNALS TO BE PLACED; REPEALING ALL ORDINANCES OR PARTS THEREOF WHICH ARE IN CONFLICT HEREWITH PROVIDING THAT THIS ORDINANCE SHALL ONLY AFFECT STREETS SPE- CIFICALLY SET FORTH HEREIN AND THAT THIS ORDINANCE IS CUMULATIV1 ; PROVIDING A SAVINGS CLAUSE; PRESCRIBING A PENALTY; AND PROVIDING FOR PUBLICATION OF THIS ORDINANCE. WHEREAS, the governing body Bf the City of Lubbock, Texas, deems it in the public interest, safety~ health and general welfare that certain 20 MPH school zones be eliminated, and that others should be set up as hereinafter set forth in the body of this Ordinanee to better handle and control vehicular traffic for the safety of the citizens of the City of Lubbock in general and school child ... ren thereof in particular; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 4251 of the City of Lubbock is hereby amended by deleting therefrom Subsection 23, Section 2 of said Ordinance in its entirety so that from and after the effective date hereof, 50th St~eet beginning 200 feet East of the East side of the intersection of Orlando Avenue and extend- ing West for 430 feet shall no longer be a 20 MPH School Zone. SECTION 2. THAT Ordinance No. 5327 of the City of Lubbock is hereby repealed in its entirety. SECTION 3. THAT the prima facie speed limit established by Article 6701D, Section 166(a)(1), Vernon1s Texas Civil Statutes, is altered and changed for all vehicles to TWENTY (20) miles per hour during the time the flashing traffic control signal is in operation on the following designated highways or streets in the corporate limits of the City of Lubbock, Lubbock County, Texas> to-wit: A. On the West side of Avenue U beginning at a point 30 feet South of Duke and extending Southward for 635 feet. B On the East side of Avenue U beginning at a point 665 feet South of Duke and extending Northward 63 5 feet. C. On the North side of E. 24th Street beginning at a point 75 feet East of Otk Avenue and extending West .. ward for 710 feet. D. On the South side of E 24th Street beginning at a point 685 feet West of Otk Avenue and extending Eastward for 795 feet. SECTION 4. THAT the City Manager is authorized and directed to cause the placing of signs and traffic control signals so as to clearly define the limits . of the prima facie areas set out in this Ordinance. SECTION 5. THAT all Ordinances or parts of Ordinances conflicting with any of the provisions hereof are hereby repealed insofar as such conflict exists. SECTION 6. THAT all Hghways or streets not specifically set forth in the preceding sections hereof shall not be affected by the provisions hereof, and this Ordinance shall be cumulative of all other prima facie speed limit Ordinances except those with which it specifically conflicts. SECTION 7. THAT should any Section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitution·a1 or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 8. THAT any person., firm or corporation violating the prima facie speed limit established by this Ordinance shall, upon conviction, be fined any sum not to exceed TWO HUNDRED ($200. 00) DOLLARS. SECTION 9. THAT the City Secretaryis authorized and directed to cause the publication of the descriptive caption of this Ordinance togaher with the penalt provision as an alternative method of publication as provided by law. AND IT IS SO ORDERED.
