HomeMy WebLinkAboutOrdinance - 9168-1988 - Adding A Chapter 7 To New Article IV Assign Pay Fire Department - 01/28/1988DGV :js Firs~A{~~ding Jamtary 28, 1988 Item #26 Second Reading February 11, 1988 Item #5 ORDINANCE NO •. 9168 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, BY ADDING TO CHAPTER 7 A NEW ARTICLE IV PERTAINING TO ASSIGNMENT PAY FOR CERTAIN MEMBERS OF THE FIRE DEPARTMENT; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, Section 143.042 of the local Government Code provides that a municipality may by Ordinance provide for assignment pay for certain civil service employees who are performing specialized functions; and WHEREAS, members of the Fire Prevention Division and the Training Division receive less pay for working regularly scheduled hours than do members assigned to fire stations due to provisions of the Federal Fair Labor Standards Act; and WHEREAS, members of the Fire Prevention Division and the Training Division are required to master specialized skills and training and acquire State Certifications over and above those required for members assigned to fire stations; and WHEREAS, it is of great importance to provide an appropriate and fair level of pay in order to attract and retain capable and motivated individuals for these vitally important positions; and WHEREAS, the City Council of the City of lubbock deems it to be in the best interest of the citizens of the City of Lubbock'to provide for assign- ment pay for members of the lubbock Fire Department Fire Prevention Divi- sion, except for the Fire Marshal, and the Training Division; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the Code of Ordinances of the City of Lubbock, Texas, BE and are hereby amended by adding thereto a new Article IV to Chapter 7, which shall read as follows: ARTICLE IV. ASSIGNMENT PAY Sec. 7-65. Authorization. The City Council of the City of lubbock hereby authorizes as- signment pay in addition to the regular pay received by Civil Service members of the following named divisions of the Lubbock Fire Department due to the specialized functions of such members: a) Fire Prevention Division (except for Fire Marshal}. b) Fire Training Division. Sec. 7-66. Amount. Assignment pay for eligible Civil Service members of the lubbock Fire Department shall be such rate as is established by the City of lubbock Budget and approved by the lubbock City Council. SECTION 2. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any rea- son, the remainder of this Ordinance shall not be affected thereby. SECTION 3. THAT the City Secretary is hereby authorized to cause pub- lication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
