WHEREAS, the City Council finds that the underground utility ease~rent and garbage collection ease~rent as hereinafter described in the body of this Ordinance are no longer needed for public use and it would be in the plblic interest to close, vacate and abandon the same; H::M THEREFORE: BE IT ORDAINED BY THE CITY COIJN:IL OF THE CITY OF LOBIO:l{: SEX:'l'ION 1. THAT the portion of the underground utility easement and garbage collection easeJrent as hereinafter described shall BE and the same is hereby closed, vacated and abandoned for easetrent purposes and plblic use: METES AND B:XJNDS DES:RIP!'ION for a 20 foot underground utility and garbage collection easeaent located in Lots 17 and 18, Iris Gardens Addition to the City of Lubbock, Lubbock County, Texas, to be closed and abandoned, being further described as follows: BEGINNIN3 at the Northwest corner of Lot 17 and at the Northeast corner of Lot 18, Iris Gardens .Mdition to the City of LUbbock, Lubbock County, Texas; THENCE East a distance of 10.00 feet; THENCE South a distance of 123.00 feet; THENCE s. 45° E. a distance of 14.14 feet; THENCE West a distance of 40.00 feet; THENCE N. 45° E. a distance of 14.14 feet; THENCE North a distance of 123.00 feet; THENCE East a distance of 10.00 feet to the POINT OF BEGINNilG. TBM.' the City Engineer shall mark said ·abandoning and closing on the official maps of the City, giving the nrmber of the Ordinance and the date of final passage. SEX:'l'ION 3. TBAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SEX:'!'ION 4. TBAT the City Secretary is hereby authorized and directed to cause p.lblication of the descriptive caption of this Ordinance as an alternative method provided by law.
