' HW:da 3019 File And Return To Ed Ducy R-0-W First Reading January 14, 1988 Item 14 Second Reading January 28, 1988 Item 9 ORDINANCE NO. 9159 ----- AN ORDINANCE ABANDONING AND CLOSING TWO TRANSFORMER PAD EASEMENTS AND TWO UNDERGROUND UTILITY EASEMENTS LOCATED IN LAKERIDGE COUNTRY CLUB ESTATES ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, EACH OF WHICH IS MORE PARTICULARLY DESCRIBED HEREINAFTER IN THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY OF LUBBOCK TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the transformer pad easements and underground utility easements as hereinafter described in the body of this Ordinance are no longer needed for public use and it would be in the public interest to close, vacate and abandon the same; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the transformer pad easements and underground utility easements as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for easement purposes and for public use; TRACT 1 A transformer pad easement for Lubbock Power and Light Company, located in Lot 475, Lakeridge Country Club Estates, and Addition to the City of Lubbock, Lubbock County, Texas, being further described as follows: BEGINNING at a point which bears N. 88°30' E. a distance of 10.00 feet from the Northwest corner of Lot 475, Lakeridge Country Club Estates, an Addition to the City of Lubbock, Lubbock County, Texas; THENCE N. 88°30' E. a distance of 4.00 feet; THENCE S. 01°30' E. a distance of 6.00 feet; THENCE S. 88°30' W. a distance of 4.00 feet; THENCE N. 01°30' w. a distance of 6.00 feet to the POINT OF BEGINNING. TRACT 2 A transformer pad easement for South Plains Electric Co-op, located in Lot 474, Lakeridge Country Club Estates, an Addition to the City of Lubbock, Lubbock County, Texas, being further described as follows: VOt2734 PAGE 24 BEGINNING at a point which bears N. 88°30 1 E. a distance of 10.00 feet from the Southwest corner of lot 474, lakeridge Country Club Estates, an Addition to the City of lubbock, lubbock County, Texas; THENCE N. 88°30' E. a distance of 4.00 feet; THENCE N. 01°30 1 w. a distance of 6.00 feet; THENCE S. 88°30 1 w. a distance of 4.00 feet; THENCE S. 01°30' E. a distance of 6.00 feet to the POINT OF BEGINNING. TRACT 3 A 4.5 foot wide underground utility easement for lubbock Power and light Company, located in lot 474, lakeridge Country Club Estates, an Addition to the City of lubbock, lubbock County, Texas, being further described as follows: BEGINNING at a point which bears N. 88°30' E. a distance of 10.00 feet from the Northwest corner of lot 474,. lakeridge Country Club Estates, an Addition to the City of lubbock, lubbock County, Texas; THENCE N. 88°30' E. a distance of 110.00 feet; THENCE S. 01°30 1 E. a distance of 4.50 feet; THENCE S. 88°30 1 w. a distance of 110.00 feet; THENCE N. 01°30' w. a distance of 4.50 feet to the POINT OF BEGINNING. TRACT 4 A 5 foot underground utility easement for South Plains Electric Co-op, located in lot 473, lakeridge Country Club Estates, an Addition to the City of lubbock, lubbock County, Texas, being further described as follows: BEGINNING at a point which bears N. 88°30' E. a distance of 10.00 feet from the Southwest corner of lot 473, lakeridge Country Club Estates, an Addition to the City of lubbock, lubbock County, Texas; THENCE N. 88°30' E. a distance of 110.00 feet; THENCE N. 01°30' W. a distance of 5.00 feet; THENCE S. 88°30' W. a distance of 110.00 feet; -2- .. .. THAT the City Engineer shall mark the official maps of the City of lubbock to indicate said abandoning and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
