HomeMy WebLinkAboutOrdinance - 6671-1973 - Zoning Change-Case 1850-A, W. 90' Of The S. 150' Of Lot 535, Kuykendall Heights - 06/28/1973J:pr ORDINANCE NO._.lol..l66iol...l7....._1 __ _ AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 AND THE FFICIAL MAP OF THE CI'IYOF LUBBOCK SO AS TO MAKE THE FOLLOWlliG CHANGE: ZONE CASE NO. 1850-A: CHANGE THE WEST 90 FEET OF THE SOUT 50 FEET OF LOT ~35, KUYKENDALL HEIGHTS ADDITION, CITY OF LUBBOCK, UBBOCK COUNTY, TEXAS, FROM A "C-211 TO A "C-211 SPECIFIC USE PERMIT HOSPITAL OR CLINIC FOR SMALL ANIMALS; PROVIDING A SAVINGS CLAUSE ND PROVIDING FOR PUBLICATION. WHEREAS, after receiving the recommendations of the Planning and Zoning ommission and after due notice and public hearing and all matters having been done and performed as required by Section 14-A of Zoning Ordinance No, 1695 of he City of Lubbock (said Ordinance being an Appendix to the Lubbock City Code} elating to Specific Use permits .. the City Council finds that due to changed condi- ions, it would be expedient and in tie interest of the public health, morals and general welfare to authorize the granting of a Specific Use Permit as hereinafter set forth, NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the Director of Planning of the City of Lubl:x:ick is authorized to issue a Specific Use Permit to the Applicant in Zone Case No, 1850-A in accordance with the recommendations and conditions imposed by the Planning and Zoning Commission, on file with the office of the Director of Planning, and the City Council which are hereby adopted and incorporated herein by reference for all purposes, provided said Applicant agrees to be bound by the terms of the Specific Use Permit, the granting of which is hereby made subject to compliance to all pro- visions of Zoning Ordinance No. 1695 an Ordinance of the City of Lubbock, includin particularly but not limited to, Section 14-A of Zoning Ordinance No. 1695 within twenty-four (24) months of the effective date of this Ordinance, the City Secretary- Treasurer shall be and is hereby authorized and instructed, upon written notice fr the Director of Planning that Applicant has not complied with the provisions .. condi tiona and terms imposed by this Ordinance .. to note Applicant's failure to comply on the margin of the Minutes of the City Council opposite entry of this Ordinance, and the authorization to issue such Specific Use Permit is hereby revoked; and the Director of Planning in such event is directed to remove from the Zoning Map the legend indicating such limited use. The Specific Use authorized by this Ordinance is for hospital or clinic for small animals, under provisions of Section 14-A.l-17 of the Zoning Ordinance on the property below described: ZONE CASE NO. 1850-A: Change the West 90 feet of the South 150 feet of Lot 535, Kuykendall Heights Addition to the City of Lubbock, Lubbock Courty, Texas, from a "C-211 to a "C-211 Specific Use Permit Zone Change; Hospital or clinic for small animals. :pr SECTION 2. THAT from and after passage and effective date of this Ordinance said lots, t.racts and. parcels of land described in Section 1 hereof shall be changed to the Zoning District indicated and the Official Map is amended in accordance herewith. SECTION 3. THAT should any section1 paragraph,. sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publica tion of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT ISSO ORDERED.
