ORDINANCE NO. 6669
AN ORDINANCE AMENDING ORDINANCE NO. 5396 OF THE CITY OF
LUBBOCK, WHICH COVERED ZONE CASE NO. 1906, BY AMENDING THE CON-
DITIONS IN SUBSECTION F OF SECTION 1 THEREOF AS APPLIED TO A TRACT
OF LAND OUT OF SECTION 28,1 BLOCK E-2, CITY OF LUBBOCK, LUBBOCK
COUNTYl' TEXAS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE
AND PROVIDING FOR PUBLICATION.
WHEREAS, the City Council has determined that the changes in conditions
required in the zone case as shown below would be in the best interest of the
citizens of the City of Lubbock; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Sub-section F.l. of Section 1 of Ordinance No. 5396 of
the City of Lubbock, be and is hereby amended by amending conditions a and c
thereof as such conditions apply to a tract of land out of Section 28, Block E-2,
City of Lubbock, Lubbock County, Texas, as described in application in Zone Cas
No. 1906 on file in Planning and Zoning Department to which reference is here
made for more particular description of said land, so that conditions shall read
as follows:
"a. That a 43' building set b~ck from the North and
South property lines be observed.
c. That a 2. 2 to 1 parking ratio of paved off-street
parking area be maintained. 11
SECTION 2. The changes in conditions set forth above shall apply only to th
property stated therein and shall not change or invalidate the existing conditions
placed on the property described in Ordinance No. 5396.
SECTION 3. THAT any person, firm or corporation owning or operating the
subject property failing to comply with the conditions imposed by Section 1 hereof
shall be guilty of a misdemeanor and upon conviction thereof shall be subject to a
fine not to exceed TWO HUNDRED DOLLARS and each and every day's violation
thereof shall constitute a separate and distinct offense.
The failure of any corporation owning or operating the subject property to
comply with any of the conditions imposed by Section 1 hereof shall render the
President, Vice-President, General Manager, Local Manager and Local Agent
liable to the penalty prescribed in this section.
SECTION 4. THAT should any section, paragraph, sentence, clause, phnase
or word of this Ordinance be declared unconstitutional or invalid for any reason,
the remainder of this Ordinance shall not be affected thereby.

SECTION 5. THAT the City Secretary is hereby authorized to cause publica-
tion of the descriptive caption o£ this Ordinance as an alternative method provided
by law.
AND IT IS SO ORDERED.
