DENISIONS SUB DIVISION, BOTH BEING SUBDIVISIONS OF THE ROBERTS AND MC WHORTER ADDITION TO THE CITY OF LUBBOCK., LUBBOCK COUNTY, TEXAS., AS MO PARTICULARLY DESCRIBED 1N THE BODY OF THIS ORDINANCE; ALL OF SAD PORTIONS OF STREETS AND ALLEYS BEING LOCATED IN THE CITY OF LUBBOCK., LUBBOCK COUNTY, TEXAS; DIRECTJliiG THE CITY ENGINEER T MARK THE OFFICIAL MAP OF THE CITY OF LUBBOCK TO INDICATE THE C 0· SlliG AND ABANDONMENT OF SAID PORTIONS OF STREETS AND ALLEYS; P 0- VIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that certain portions of streets and alley as hereinafter described in the body of this Ordinance are no longer needed for street and alley purposes and for public use; and, WHEREAS, the City Council finds it oo uld be to the public interest to clos vacate and abandon the same for street and alley purposes and to public use; an ., NOW THEREFORE: BE IT ORO\ INED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the portions of streets and alleys as hereinafter descri ec shall be and the same are hereby closed. vacated and abandoned for street and a le~ purposes and for public use: TRACT I Portion of First Street between its intersections with A venue S and Santa Fe Railway Right of Way described by metes and bounds as follows: BEGINNING at an iron rod set at the intersection of the North line of First Street with the Southwesterly right-of-way line of the Santa Fe RailroadJ the Northeast and beginning corner of this tract; THENCE South 57~ East, along said right-of-way_. 110.16 feet to an iron rod set at the intersection of said right-of-way line with the South line of First Street., the Southeast corner of this tract; THENCE West along said South line of First Street, 216.18 feet to an iron rod set for the Southwest corner of this tragt; JWF:pr THENCE North., 20.0 feet to a point, the P. C. of a curve to the left and a corner of this tract; THENCE Northwesterly~ around the arc of said curve of radius 40. 0 feet, an arc distance of 62. 83 feet to a point in the North line of First Street for the Northwest corner of this tract; THENCE East, along said North line of First Street, 163. 79 feet to the PLACE OF BEGINNING. TRACT II Portion of A venue R between its intersections with Second Street and Santa Fe Railway Right of Way described by metes and bounds as follows: IBEGINNING at the Southeast corner of Block 36, Cook Sub- division of the Roberts and McWhorter Addition to the City of Lubbock, Lubbock County, Texas, the same being the inter- section of the North line of 2nd Street and the West line of Avenue THENCE North along the West line of Avenue R to the point of intersection of the West line of Avenue R with the South line of the Santa Fe Railroad ROW; THENCE Southeasterly along said ROW line to the point of intersection of said ROW line with the East line of Avenue R; THENCE South a distance of 549 feet to the Southwest corner of Block 35, Denisions Subdivision of the Roberts and McWhorter Addition to the City of Lubbock, Lubbock County, Texas, the same being the intersection of the North line of 2nd Street and the East line of Avenue R; THENCE West a distance of 50 feet to the FO INT OF BEGINNING. TRACT III Portion of A venue Q between it s intersection ~ith Second Street and Santa Fe Railway Right of Way described by metes and bounds as follows: BEGINNING at the Southeast corner of Block 35, Denisions Sub- JWF:pr THENCE Southeasterly along said ROW line to the intersection of said ROW line with the East line of Avenue Q; THENCE South a distance of 339.7 feet to the Southwest corner of Block 34, Easley Subdivision of the Roberts and McWhorter Addition to the City of Lubbock, Lubbock County,, Texas, the same being the intersection of the North line of 2nd Street and the East line of A venue Q; THENCE West a distance of 50.3 feet to the P01NT OF BEGINNING. TRACT IV The alley located in Block 36, Cook Subdivision, described by metes and bounds as follows; BEGINNING at the Northeast corner of Lot 30, Block 36, Cook Subdivision of the Roberts and McWhorter Add tion to the City of Lubbock, Lubbock County, Texas; THENCE South a distance of 557. 79 feet; THENCE Southeasterly along the North line of Cb:>vis Road to its point of intersection with the East line of the North-South Alley in said Block 36; THENCE North a distance of 567. 88 feet; THENCE West a distance of 10 feet to the POrnT OF BEGINNING. TRACT V The alley located in Block 35, Deni:sfr>ns Subdivision described by metes and bounds as follows: BEGINNING at the Southeast corner of Lot ll., Block 35, Denisions Subdivision of the Roberts and McWhorter Addition to the City of Lubbock, Lubbock County, Texas; THENCE North a distance of 463.8 feet; THENCE Southeasterly along the South ROW line of Santa Fe Railroad to the intersection of the East line of the North-South Alley in said Block 35 with the South line of said Santa Fe Railroad ROW line; THENCE South a distance of 457.6 feet; THENCE West a distance of 10 feet to the POlliT OF BEGINNING. THAT the City Engineer is hereby authorized and directed to mark the official map of the City of Lubbock to indicate that the streets and alleys described in Section 1 hereof have been closed and abandoned, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, claus or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
