AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 AND THE
OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING
CHANGES: ZONE CASE NO. 1875: CHANGE LOTS OI?T OF A PRELIMINARY
PLAT OF COMMANDERS ADDITION~ ON FILE IN THE OFFICE OF THE
SECRETARY OF THE PLANNING AND ZONING COMMISSION1 OUT OF SECTION
431 BLOCK AK, CITY OF LUBBOCK1 LUBBOCK COUNTY1 TEXAS1 FROM AN
"R-111 TO A trc-2" and "C-411 ZONING DISTRICTS AS FURTHER DESCRIBED IN
SECTION 1 BELOW: PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUB
LICATION; SUBJECT TO CONDITIONS; PROVIDING A PENALTY.
WHEREAS, the proposed change in zoning districts as hereinafter made
has been duly presented to the Zoning and Planning Commissien for its recommen a-
tion, which was received by the City Council and after due consideration~ the
City Council finds that making the proposed change as hereinafter set out will be
in the public interest; and,
WHEREASu all conditions precedent required by law for a valid amendment
to the Zoning Ordinance and Map have been fully complied with, as well as giving
notices in compliance with Section 20 of Ordinance No: 1695 as well as notices
provided by Article 10llf1 Vernon 1S Annotated Civil Statutes, amended in 1961, and
notit1:e was duly published in the Lubbock Morning Avalanche Journal more than
fifteen (15) days prior to the date of the public hearing be fore the City Council on
such proposed amendment, and the public hearing according to ::;;aid notice was du
held in the City Council Room on the second floor of the City Hall, Lubbock, Texa ,
at waich time persons appeared in support of the proposal; and, after said hearin
it was by the City Council determined that it would be in the public interest .. due t
changed conditions, that the Zoning Ordinance ~nd the Zoning Map be amended in
the manner hereinafter set forth in the body of this Ordinance and this Ordinance
having been introduced prior to first reading hereof; NOW THEREOFRE:
BE IT ORDAINED BY THE CITY COUNCILOF THE CITY OF LUBBOCK:
SECTION 1. THAT Ordinance No. 1695 and the Official Map BE and the sam
are hereby amended as follows. to-wit:
ZONE CASE NO. 1875
Change the following lots out of a preliminary plat of
Commanders Addition, on file in the office of the Secretary
of the Planning and Zoning Commission, out of Section 43.,
Block AK, City of Lubbock .. Lubbock County, Texas:
Change Lot 4, Commanders Addition, from an 11R-111 to a
"C-211 Zoning District.
Change Lot 31 Commanders Additio11 from an ''R-111 to
a 11C-4 11 Zoning Distrie t, restricted to bar, lounge, nightclub1private lut
supperclub and "C-211 Zoning Dis'trict uses.
Change Lot 5, Commanders Addition, from an "R-111
to a "C-4" Zoning District, restricted to mobile home
sales and "C-2'' zo·ne District uses.
Change Lot 6, Commanders Addition, from an "R-1" to
a "C-4" Zoning District.
SUBJECT TO THE FOLLOWING CONDITIONS:
1. That a 50 foot building setback be maintained on Lots 3, 4, 5
and 6 from the north property line.
2. That "C-2 11 sign regulations shall apply to Lots 3, 4, 5 and 6.
3. That a solid 6 foot permanent type screening fence of wood or
masonry construction be constructed and permanently
maintained along the West side of Lot 3, and along the south
side of Lots3, 4, 5 and 6.
SECTION 2. ~HAT from and after passage and effective date of this
Ordinance said lots, tracts and parcels of land described in Section 1 hereof
shall be changed to the Zoning District indicated and the Official Map is amended
accordance herew1th.
SECTION 3. THAT any person, firm or corporation owning or operating
subject property failing to comply with the conditions imposed by Section 1 hereof
shall be guilty of a misdemeanor and upon conviction thereof, shall be subject to
fine not to exceed TWO HUNDRED DOLLARS and each and every day's violati2n
thereof shall constitute a separate and distinct offense.
The failure of any corporation owning or operating the subject property to
comply with any of the conditions imposed by Section 1 hereof shall render the
President, Vice-President, General Manager, Local Manager and Local Agent
liable to the penalty prescribed in this section. ·
SECTION 4. THAT should any section, paragraph, sentence, clause,
or word of this Ordinance be declared unconstitutional or invalid for any reason,
the remainder of this Ordinance shall not be affected thereby.
SECTION 5. THAT the City Secretary is hereby authorized to cause pub
tion of the descriptive caption of this Ordinance as an alternative method provide
by law.
AND IT IS SO ORDERED.
