OFFICIAL MAP OF THE CITY OF. LUBBOCK SO AS TO MAKE THE FOLLOWING
CHANGE: ZONE CASE NO. 1699: CHANGE TWO TRACTS OF LAND OUT OF
SECTIONS~ BLOCK E~ CITY OF LtrBBOCK~ LUBBOCK COUNTY# TEXAS, FRO~
AN "R-1" TO A "C-4'' ZONING DISTRICT EXCEPT THE WEST 545 FEET OF SUC~
TRACTS WHICH ARE TO BE CHANGED FROM AN "R-1" TO AN "A-1" ZONING
DISTRICT: SUBJECT TO CONDITIONS ON THE "C-4" ZONING DISTRICT ONLY;
PROVIDlNG A PENALTY; PROVIDJNG A SAVlNGS CLAUSE AND PROVIDING FOF
PUBLICATION.
WHEREAS# the proposed change in zoning districts as hereinafter made has
been duly presented to the Planning and Zoning Commission for its recommendati< n ..
which was received by the City Council and, after due consideration, the City
Council finds that making the prop<B ed change as hereinafter set out will be in
the public interest; and,
WHEREAS~ all conditions precedent required by law for a valid amendment
to the Zoning Ordinance and Map have been fully complied with, as well as giving
notices in compliance with Section 20 of Ordinance No. 1695 as well as notices
provided by Article lOllf, VernQ:n's Annotated Civil Statutes, amended in 1961., and
notice was duly published in the Lubbock Morning Avalanche Journal more than
fifteen (15) days prior to the date of the public hearing before the City Council on
such proposed amendment# and the public hearing acco:.£-ding to said notice was duJ 11
held in the City Council Room on the second floor of the City Hall, Lubbock, Texas ...
at which time persons appeared in support of the proposal; and~ after said hearing
it was by the City Council determined that it would be in the public interest, due t<
changed conditions~ that the Zoning Ordinance and the Zoning Map be amended in
the manner hereinafter set forth in the body of this Ordinance and this Ordinance
having been introduced prior to first reading hereof; NOW THEREFORE:
BE IT ORDAlNE D BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and
the same are hereby amended as follows, to-wit:
ZONE CASE NO. 1699:
Change two tracts of land out of Section 5, Block E, City
of Lubbock, Lubbock County, Texas, from an 11R-1" to an
"C-411 Zoning District except the West 545 feet of such tracts
which shall be changed from an "R-111 to an "A-1" Zoning
District. Property. is further, describe~ as. shown on ~xhibit
"A " attached. ,
SUBJECT TO THE FOLLOWING CONDITIONS (for the "C-4" Zoning District only)
1. Set back 43 feet from 66th Street.
2. Set back 160 feet from U. S. Highway 87.
3. Set back 25 feet from all interior otreet within development.

4. Set back 100 feet from the West property line of the "c-411 property
South of Loop 289,.
5. Construct 6' concrete sidewalks adjacent to all streets.
6. Parking C-4 Zoned areas:
Retail uses will provide 2. 2:1 parking ratio per square foot of
retail are a.
Hotel & Motel uses will provide 1 parking space per rentable room.
Other uses will provide 1 parking space per employee., 1 parking
space per service vehicle operated by occupant., 2 parking spaces per
loading dock and 1 customer parking space per 500 square feet of
display area.
7. No outside storage to be allowed.
I. Signs:
Pylon sign placement along Loop 289 and U. S. 87 will be limited to 1
pylon sign per occupant and such pylon ... ~igns will be placed no closer
than 200 feet from any other sign, said distance to be measured along
a line parallel to the Highway or Loop frontage.
Sign height shall be limited to 45' except that a sign located within
300' of residential uses shall be limited to 21' in height.
There shall be no pylon signs within 2001 of 66th Street except one
11Center Identification Signtl which shall be limited to 21 1 in height.
There shall be no flashing or exposed Neon signs.
There shall be no "A" frame signs,. portable signs nor "Two Party" sign .
9. Loading docks and service areas including garbage collection areas shal
be screened from exterior public streets by decorative screeni.q; fences or ~nc
scape either of which shall be lproperly maintained at all times. Any dama~ ~
to said screening shall be immediately repaired and redecorated appropriat ly
dead or damaged plantings shall be immediately replaced with appropriate
plantings in order that such screens will be functional and present an
appealilng appearance.
10. Site landscaping -A minimum of 5o/o of the gross land area at the time c
development of each lot or tract under development shall be devoted to land-
scaping. Underground water lines shall be provided at the time of construc1 on
to each planting area sufficient to provide irrigation necessary for the
maintenance of plantings. Planting area shall be properly maintained to
present an appealing appearance at all times. Dead plants shall be removec
and replaced immediately. Areas shall be kept clear of all weeds and unde-
sirable growth and trash.

SECTION 2. That from and after passage and effective date of this
Ordinance said lots, tracts and parcels of land described in Section 1 hereof shall
be changed to the Zoning District indicated and the Official Map is amended in
accor.dance herewith.
SECTION 3. THAT any person, firm or corporation owning or operating
the subject property failing to comply with the conditions imposed by Section 1
hereof shall be guilty of a misdemeanor and upon conviction thereof, shall be
subject to a fine not to exceed TWO HUNDRED DOLLARS and each and every day's
violation thereof shall constitute a separate and distinct offense.s
The failure of any corporation owning or operating the subject property to
comply with any of the conditions imposed by Section 1 hereof shall render the
President., Vice-President, General Manager, Local Manager and Local Agent
liable to the penalty pll!escribed in this section.
SECTION 4. THAT should any section, paragraph, sentence, clause, phrase
or word of this Ordinance be declared unconstitutional or invalid for any reason,
the remainder of this Ordinance shall not be affected thereby.
SECTION 5. THAT the City secretary is hereby authorized to cause publica-
tion of the descriptive caption of this Ordinance as an alternative method provided
by law.
AND IT IS SO ORDERED.
