HomeMy WebLinkAboutOrdinance - 9322-1989 - Amending Chapter 8 Amending Languages Of Portions Of Section 8-4 - 12/07/1989II i ,, DGV:js First, Reading December 7, 1989 Item #21 Second Reading December 14, 1989 Item #10 ORDINANCE NO. 9322 AN ORDINANCE AMENDING CHAPTER 8 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, BY AMENDING THE LANGUAGE OF PORTIONS OF SECTION 8-4 WITH REGARD TO CERTAIN POLLING PLACES; ALTERING CERTAIN PRECINCT BOUNDARIES AS REQUIRED BY STATE LAW; PROVIDING A MAP OF THE VOTING PRECINCTS OF THE CITY OF LUBBOCK; PROVIDING THAT ALL PORTIONS OF CHAPTER 8 NOT AMENDED SHALL RE- MAIN THE SAME; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Lubbock deems it to be in the best interest of the citizens of the City of Lubbock to change the polling place for certain precincts in order to facilitate voting; and WHEREAS, Section 42.061 of the Texas Election Code mandates that city voting precinct boundaries conform to county voting precincts boundaries except where the city limits prevent conformance; and WHEREAS, certain changes to the Lubbock County voting precincts within the City of Lubbock have been made by the Lubbock County Commissioners Court, effective January 1, 1990; and WHEREAS, Section 276.006 of the Texas Election Code requires all changes to election district boundaries to be completed more than five (5) months prior to any election to be effective; and WHEREAS, the next regular City general election is required to be held May 5, 1990, which requires all changes to election district boundaries be completed prior to January 5, 1990; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the Code of Ordinances of the City of Lubbock, Texas, BE and is hereby amended by altering the polling place recited in Section 8-4 for certain City voting precincts as follows: Voting Precinct No. 71 Voting Precinct No. 73 The voting place shall be Broadview Baptist Church. The voting place shall be Crestview Elementary School. SECTION 2. THAT the Code of Ordinances of the City of Lubbock, Texas, BE and is hereby amended by replacing the boundary description recited in Section 8-4 for certain City voting precincts with the following boundary descriptions: VOTING PRECINCT NO. 5. Beginning at the intersection of Erskine Street with North Avenue Q; thence East along Erskine Street to its intersection with Amarillo Road; thence South along Amarillo Road to its intersection with 3rd Street; thence East at the entrance into Mackenzie State Park and Southeast along the park road past Parkway Drive to the intersection of the park road with the Yellowhouse Fork of the Brazos River near Broadway; thence South along the Yellowhouse Fork of the Brazos River to its intersection with East 19th Street; thence West along East 19th Street to its intersection with Avenue H; thence North along Avenue H to its intersection with the Eastward projection of the North edge of the alley between Main Street and Broadway Street; thence West along the eastward projection of the North edge of the alley between Main Street and Broadway Street to its intersection with Avenue Q; thence North along Avenue Q and North Avenue Q to the point of beginning. The Voting Place shall be Guadalupe Elementary School. VOTING PRECINCT NO. B. BEGINNING at the intersection of 4th Street and Avenue Q; thence South along Avenue Q to its intersection with the North edge of the alley between Main Street and Broadway Street; thence West along the North edge of the alley between Main Street and Broadway Street to its intersection with University Avenue; thence North ·along University Avenue to its intersection with 4th Street; thence East along 4th Street to the point of beginning. The Voting Place shall be Ramirez Elementary School. VOTING PRECINCT NO. 10. BEGINNING at the intersection of Avenue H and 19th Street; thence West along 19th Street to its intersection with University Avenue; thence North along University Avenue to its intersection with the South edge of the westward projection of an East-West 20 foot wide alley between Main Street and Broadway Street, and in Block 99, Overton Addition to the City of Lubbock; thence East, along the South edge of said alley and along its eastward extension across the center of Block 120 and 121, Overton Addition (there being no East-West alley in these blocks) and continuing eastward to the intersection with Texas Avenue; thence South a distance of 33.20 feet to a point; thence East along a line which divides the wall space equally between the two Justice of the Peace offices (and along a line parallel to and a distance of 141.80 feet North of the center line of Broadway) to the center line of Avenue H; thence South along Avenue H to the point of beginning. The Voting Place shall be Lubbock High School. VOTING PRECINCT NO. 50. BEGINNING at the intersection of Indiana Avenue and 4th Street; thence East along 4th Street to its intersection with University Avenue; thence South along University Avenue to its intersection with the North edge of the Westward pro- jection of an East-West 20 foot wide alley between Main Street and - 2 - Broadway Street, and in Block 99, Overton Addition to the City of Lubbock; thence East along the North edge of said alley and along its eastward extension across the center of Blocks 120 and 121, Overton Addition (there being no East-West alley in these blocks) and continu- ing eastward through the Lubbock County Courthouse to the intersection of this line with the centerline of Avenue H; thence South along the centerline of Avenue H, a distance of 53.20 feet to a point; thence West along a line which divides the wall space equally between the two Justice of the Peace offices {and along a line parallel to and a dis- tance of 141.80 feet North of the centerline of Broadway) to the intersection with Texas Avenue; thence North a distance of 33.20 feet to the East extension of the South line of the alley between Broadway Street and Main Street; thence West along the South line of the alley between Broadway Street and Main Street and its westward extension across the center of Blocks 120 and 121, Overton Addition (there being no East-West alley in these blocks) and continuing westward to the in- tersection of University Avenue; thence South along University Avenue to its intersection with 19th Street; thence West along 19th Street to its intersection with Boston Avenue; thence North along Boston Avenue to its intersection with the extension of 15th Street on the Tech cam- pus; thence West along the extension of 15th Street and continuing in a westerly direction to its intersection with Indiana Avenue; thence North along Indiana Avenue to the point of beginning. The voting place shall be as is designated by election order. SECTION 3. THAT the Code of Ordinances of the City of Lubbock, Texas, BE and is hereby amended by deleting Subsection 8-4{c) and substituting therefor the following: {c) The voting precincts and voting districts set out in this section are hereby delineated on the map denominated "City of Lubbock Voting Precincts/Districts, effective January 1, 1990/0fficial Map." A copy of said map is attached to and made part of this Ordinance as if fully copied herein in detail. A copy of the original of such map shall be kept in the office of the City Secretary and shall be avail- able for public inspection, and at each special and general city election, a true copy of said map shall be furnished by the City Secretary to each of the presiding judges of the voting precincts for such special or general city election. SECTION 4. THAT all portions of Chapter 8 of the Code of Ordinances of the City of Lubbock not hereinabove altered shall remain as they are. SECTION 5. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. - 3 - SECTION 6. THAT the City Secretary of the City of lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method of publication provided by law. SECTION 7. THAT this Ordinance shall be effective from and after January 1, 1990. AND IT IS SO ORDERED. Passed by City Council on first reading this 7th day of December 1989.
