ORDINANCE NO. 9318
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP
OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 2437-B;
A ZONING CHANGE FROM C-2 TO C-3 ZONING ON A TRACT OUT OF SECTION 29, BLOCK
A-K, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDING A PENALTY; PROVIDING A
SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS, the proposed changes in zoning as hereinafter made have been
duly presented to the Planning and Zoning Commission for its recommendation
which was received by the City Council and, after due consideration, the
City CQuncil finds that due to changed conditions, it would be expedient and
in the interest of the public health, safety and general welfare to make
those proposed changes in zoning; and
WHEREAS, all conditions precedent required by law for a valid amend-
ment to the Zoning Ordinance and Map have been fully complied with, as well
as giving notices in compliance with Section 29-29 of the Code of Ordi-
nances, City of Lubbock, Texas, as well as notices provided by Section
211.007(c), Texas Local Government Code, and notice was duly published in
the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date
of the public hearing before the City Council on such proposed amendment,
and the public hearing according to said notice was duly held in the City
Council Chamber of the Municipal Building, Lubbock, Texas, at which time
persons appeared in support of the proposal; and, after said hearing, it was
by the City Council determined that it would be in the public interest, due
to changed conditions, that the Zoning Ordinance and the Zoning Map be
amended in the manner hereinafter set forth in the body of this Ordinance
and this Ordinance having been introduced prior to first reading hereof; NOW
THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
ZONE CASE NO. 2437-B
SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and
the same are hereby amended as follows, to-wit:
A change of zoning from C-2 to C-3 zoning district, under provisions
of Section 29-29 of the Code of Ordinances of the City of Lubbock, on
a tract out of Section 29, Block A-K, City of Lubbock, Lubbock County,
Texas, located at the Northwest corner of 82nd Street and Frankford
Avenue.
METES AND BOUNDS DESCRIPTION of a 13.491 acre tract of land located in
Section 29, Block A-K, Lubbock, Lubbock County, Texas and being fur-
ther described as follows:
BEGINNING at the Southeast corner of Section 2g, Block A-K, Lubbock,
Lubbock County, Texas; ·
THENCE N. 8g0 55'20" W. a distance of 1305.06 feet;
THENCE N. 00°04'40" E. a distance of 55.00 feet;
THENCE Northwesterly around a curve to the right, said curve having a
radius of 15.00 feet, a central angle of 8g0 57'03", tangent lengths of
14.gg feet and a chord distance of 21.20 feet to a point of tangency;
THENCE N. 00°01'4311 E. a distance of 1g4.88 feet to a point of curva-
ture;
THENCE Northeasterly around a curve to the right, said curve having a
radius of 15.00 feet, a central angle of goo, tangent lengths of 15.00
feet, and a chord distance of 21.21 feet;
THENCE S. 8g 0 58'1711 E. a distance of 100.00 feet to a point of curva-
ture;
THENCE Northeasterly around a curve to the left, said curve having a
radius of 210.00 feet, a central angle of goo, tangent lengths of
210.00 feet and a chord distance of 2g6.g8 feet;
THENCE S. 8g0 58'17 11 E. a distance of gg5.00 feet;
THENCE S. 00°01'43 11 W. a distance of 4g1.00 feet to the POINT OF
BEGINNING.
SUBJECT TO THE FOLLOWING CONDITION:
a. That a site plan, including building elevations showing mate-
rials, color and texture shall be submitted and approved by the
Planning and Zoning Commission prior to the issuance of a
Building Permit.
SECTION 2. THAT violation of any provisions of this Ordinance shall
be deemed a misdemeanor punishable by a fine not to exceed One Thousand and
No/100 Dollars ($1,000.00) as provided in Section 2g-31 of the Zoning Ordi-
nance of the City of Lubbock.
SECTION 3. THAT should any paragraph, sentence, clause, phrase or
word of this Ordinance be declared unconstitutional or invalid for any rea-
son, the remainder of this Ordinance shall not be affected thereby.

SECTION 4. THAT the City Secretary is hereby authorized to cause pub-
lication of the descriptive caption of this Ordinance as an alternative
method provided by law.
AND IT IS SO ORDERED.
