HomeMy WebLinkAboutOrdinance - 9301-1989 - Adopting A Budget For Fiscal Year 1989-90 - 07/27/1989-DGV:da First Reading July 27, 1989 Item #20 Second Reading August 10, 1989 Item #12 ORDINANCE NO. 9301 ---------- AN ORDINANCE APPROVING AND ADOPTING A BUDGET FOR FISCAL YEAR 1989- 90; APPROVING REVISED BUDGET FIGURES FOR FISCAL YEAR 1988-89; PROVIDING FOR NECESSARY TRANSFERS OF FUNDS BETWEEN ACCOUNTS AND DEPARTMENTS, IF REQUIRED; PROVIDING INCREASED REVENUES AS REFLECTED IN SAID BUDGET BY REVISING MINIMUM WATER RATES AS CONTAINED IN SECTIONS 28-52 AND 28-53 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK; PROVIDING INCREASED REVENUES AS REFLECTED IN SAID BUDGET BY REVISING SECTION 23-66(A){1) AND (2) OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK INCREASING CERTAIN RATES FOR GARBAGE AND TRASH COllECTION AS SET FORTH IN SAID SECTION; PROVIDING INCREASED REVENUES AS REFLECTED IN SAID BUDGET BY REVISING DUMPING RATES AT THE CITY SANITARY LANDFILL BY REVISING SECTION 23-21{b) OF THE CODE OF ORDINANCES OF THE CITY OF lUBBOCK; AND APPROPRIATING FUNDS FOR THE 1989-90 FISCAL YEAR BUDGET OF THE CITY OF LUBBOCK; AND PROVIDING A SAVINGS CLAUSE. WHEREAS, the City Manager has prepared certain figures as a 1989-90 fiscal year budget and has submitted the same to the City Council; and WHEREAS, the City Manager, on July 7, 1989, filed such proposed budget with the City Secretary for the fiscal year beginning October 1, 1989; and WHEREAS, the City Secretary did post notice that such proposed budget had been filed and a public hearing called thereon by the City Council in City Hall; and WHEREAS, the City Council determined such proposed budget for fiscal year 1989-90 to be appropriate and correct in all respects and that a11 requirements of the law have been satisfied; and WHEREAS, said budget is predicated and prepared based upon certain increases in minimum water rates; garbage and trash collection rates, and sanitary landfill dumping rates; and WHEREAS, it is necessary to amend the Code of Ordinances of the City of Lubbock to reflect said increased rates and charges in order to implement the budget for Fiscal Year 1989-90 as herein adopted; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the budget proposed by the City Manager for the fiscal year October 1, 1989, through September 30, 1990, BE and the same is hereby approved and adopted. SECTION 2. THAT the figures prepared and submitted by the City Manager for the 1989-90 fiscal year budget BE and the same are hereby approved in all respects. SECTION 3. THAT any necessary transfer of funds between accounts, departments or programs by the City Manager for City purposes or as a result of unusual or unforeseen conditions during the administration of the 1989-90 fiscal year budget BE and are hereby authorized and approved. SECTION 4. THAT amounts set out under the headings "1988-89 Revised" BE and are hereby authorized and approved. SECTION 5. THAT the several amounts, as set forth in the proposed 1989-90 fiscal year budget BE and are hereby appropriated to the objects and purposes named, subject to notification in accordance with Section 3 hereof if necessary. SECTION 6. THAT a copy of the 1989-90 fiscal year budget shall be filed with appropriate officials as required by law. SECTION 7. THAT Section 28-52 of the Code of Ordinances of the City of Lubbock pertaining to water rates BE and is hereby amended to read as follows: Sec. 28-52. Minimum rate. (a) The minimum rate for water, which shall be charged all consumers, except as otherwise provided, shall be six dollars and seventy-six cents ($6.76) per month effective October 1, 1989, until October 1, 1990, at which time the minimum rate for water shall be seven dollars and thirty-one cents ($7.31) per month. (b) In calculating the minimum rate to be charge~ townhouses or condominiums, the minimum rate shall be · multiplied by the total number of units in such building or complex subject to single billing. SECTION 8. THAT Section 28-53 of the Code of Ordinances of the City of Lubbock pertaining to water rates BE and is hereby amended to read as follows: Sec. 28-53. Rates generally. (a) The city, through its water department, shall charge and collect, and every consumer shall pay, for water furnished by the city to the consumer, the amount calculated by application of the following rates to meter readings for all billing cycles beginning on or after October 1, 1989. - 2 - AMOUNT OF WATER OCT. 1. 1989 OCT. 1. 1990 First 1,000 gal. (per thousand) •• $1.06 $1.31 (b) For townhouse or condominium complexes served by a single connection and meter, the total charges shall be calculated on the basis of determining the average water usage for each unit served and applying the minimums and rates herein provided for single consumers and multiplying such average per unit cost by the number of units served. SECTION 9. THAT Section 23-66 of the Code of Ordinances of the City of Lubbock pertaining to sanitation rates BE and is hereby amended by amending subparagraphs 23-66(a)(1) and 23-66(a)(2) to read as follows: (1) Residential: (One Unit) --Six dollars and seventy-five cents ($6.75) per month effective October 1, 1989, until January 1, 1990, then seven dollars ($7.00) per month. (2) Small commercial, churches, day nurseries, private schools, professional offices, home beauty shops, other customary home occupations, nursing homes, orphan, maternity and geriatric homes, lodges, sororities and fraternities generating less than 20 cubic feet per pickup--six dollars and seventy-five cents ($6.75) per month until January 1, 1990, then seven dollars ($7.00) per month. SECTION 10. THAT Section 23-21 of the Code of Ordinances of the City of Lubbock pertaining to landfill charges BE and is hereby amended by amending subparagraph 23-21(b) to read as follows: (b) Persons desiring to dump such wastes as described above at the designated city landfill shall pay the following fee effective October 1, 1989: SIZE OF VEHICLE CHARGE Pickups, small trailers (t-ton or less) •.. $ 3.00 Bobtail trucks, pickups overt-ton .•.•••.. $ 9.00 Semi trai 1 ers .•..••.•.••••••••••..••.•..••. $15.00 Container trucks and packer trucks: 20 cubic yards •.•.......••...••.•..• $30.00 24 cubic yards ...................... $36.00 28 cubic yards ...................... $42.00 30 cubic yards ...................... $45.00 32 cubic yards ...................... $48.00 40 cubic yards •.••.......••.•.••.... $54.00 - 3 - The city may, at its option, supercede the above schedule with a charge per ton of waste dumped of six dollars ($6.00). SECTION 11. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby.
