HomeMy WebLinkAboutOrdinance - 9298-1989 - Amending Zoning Ordinance 7084 Zone Case 922-B Huneke Addition - 07/27/1989II i DGV:js F:irst Reading July 27, 1989 Item 117 ~cr~~@ ~o~di~e9 Item 110 ORDINANCE NO. 9298 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 922-B; A ZONING CHANGE FROM R-1 SPECIFIC USE TO C-4 ZONING ON LOTS 1 & 2, HUNEKE ADDITION, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDING A PENALTY; PRO- VIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, safety and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amend- ment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 29-29 of the Code of Ordi- nances, City of Lubbock, Texas, as well as notices provided by Section 211.007{c), Texas Local Government Code, and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15} days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and,this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 922-B SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: A change of zoning from R-1 Specific Use to C-4 zoning district, under provisions of Section 29-29 of the Code of Ordinances of the City of Lubbock, on Lots 1 and 2, Huneke Addition, City of Lubbock, Lubbock County, Texas, located at the Southeast corner of 50th Street and Avenue Q. SUBJECT TO THE FOLLOWING CONDITIONS: a. That a site plan, including building elevations, showing mate- rials, color and texture shall be submitted and approved by the Planning and Zoning Commission prior to the issuance of a Build- ing Permit for any new or redevelopment of the property. b. That it shall be limited to the following permitted uses: 1. Any use conditionally or unconditionally permitted in the "C-2A," "C-2" or "C-3" districts; 2. Ambulance service; 3. Automobile brake shop; 4. Automobile glass shop; 5. Automobile seat cover and upholstery shop; 6. Automobile transmission shop; 7. Automobile and recreational vehicle sales and service (may include body and paint shop, as accessory use); 8. Barber and beauty shop supply dealer; 9. Boat and boat trailer sales and service; 10. Builders supply -All materials must be in a building; 11. Bus station; 12. Cafe supply dealer, fixtures; 13. Candy plant; 14. Dance Hall (no mixed alcoholic beverage sales permitted; 15. Garage, public, repair -(outside storage of customer au- tomobiles authorized). All work and separate parts shall be inside a building; 16. Garden center; 17. Gasoline service station-(business permitted outside of building and outside displays of products permitted within three (3) feet of the building); - 2 - 18. Hotel or motel; 19. Janitorial or cleaning service; 20. Job printing and lithographing; 21. Laboratory, chemical, general analysis; 22. Laundry, commercial; 23. Linen and towel supply service; 24. Magazine agency; 25. Muffler shop; 26. Nonprofit training centers with retail sales; 27. Pest control service; 28. Print shop; 29. Produce market; 30. Public kennel (totally within a building); 31. Restaurants (business permitted outside of building); 32. Restaurants, with the sale of alcoholic beverages as an incidental use, except that no mixed alcoholic beverage sales shall be made or delivered to occupants in motor vehicles; 33. Secondhand or used car sales lot, not including wrecking and repairing, but including minor tuning; 34. Sign shops, limited to window lettering, painted wall signs, banners and desk signs; 35. Store fixtures sales (no manufacturing permitted); 36. Swimming pool, commercial or sales (business permitted outside building); 37. Upholstery shop-Furniture; 38. Veterinary hospital (totally within a building); - 3 - 39. Wholesale house, sales office and storage -No cotton storage. SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed One Thousand and No/100 Dollars ($1,000.00) as provided in Section 29-31 of the Zoning Ordi- nance of the City of Lubbock. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any rea- son, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause pub- lication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED. •.
