HomeMy WebLinkAboutOrdinance - 9288-1989 - Amending Article XVII Chapter 2 Article V Of Chapter 6 Electrical Code. - 06/22/1989II DGV:dw First Reading June 22, 1989 · ·Item #18 Second Reading July 13, 1989 Item #7 ORDINANCE NO. 9288 AN ORDINANCE AMENDING ARTICLE XVII OF CHAPTER 2 AND ARTICLE V OF CHAPTER 6 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK WITH REGARD TO THE ELECTRICAL CODE OF THE CITY OF LUBBOCK, TEXAS; THE DUTIES OF THE BOARD OF ELECTRICAL EXAMINERS AND QUALIFICATIONS OF ELECTRICIANS WORKING IN THE CITY OF LUBBOCK; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the Board of Electrical Examiners has determined that these changes to the Electrical Code of the City of Lubbock with regard to the qualifications of electricians, technical specifications and the duties of the Board of Electrical Examiners are needed to update and clarify said Electrical Code for the benefit of the citizens of the City of Lubbock and the Board of Electrical Examiners has recommended such changes to the City Council ; and WHEREAS, the City Council of the City of Lubbock has determined that the changes hereinafter made are to the benefit of the health, safety and welfare of the citizens of the City of Lubbock; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 2-455 of the Code of Ordinances of the City of Lubbock BE and is hereby amended to read as follows: Sec. 2-455. License revocation, suspension, complaints; procedure. (a) The board is hereby authorized to hear complaints against electricians and to suspend for a period of time not to exceed one (1) year or revoke the license of any electrician licensed by the board for proper cause as hereinafter set forth in this article. (b) The board shall follow the following procedures in exercising the powers set forth in subsection (a) of this section: (1) In every case where the board is to determine whether or not an electrician's license is to be suspended or revoked or complaints are brought against any licensed electrician, the board shall proceed upon a written complaint by the building official, his representative, or any aggrieved person. The complaint shall state any violations of the electrical code together with sufficient facts, names, documents and other pertinent information necessary to enable the board to render a decision on the matter. (2) Upon receipt of a written complaint against a licensed electrician, the building official or his representative shall forward a copy of the complaint to the electrician named in the complaint by certified mail, return receipt requested. (3) The electrician named in the complaint shall have ten (10) days from the date of his receipt of a copy of the complaint in which to file a written response to the charges set forth in such complaint. The response shall be filed with the building official, who shall forward a copy of the response to the chairman of the board. {4) The chairman of the board, upon receipt of a complaint requesting a hearing or the suspension or revocation of a license of any electrician licensed by the board and a response, if any is received, shall give notice of such complaint and response to each member of the board. The board shall set a date and time to conduct a hearing into the matter at its next regularly scheduled meeting or at a special meeting called for setting the date and time of such hearing. The board shall notify the electrician of the hearing date and time by certified mail, return receipt requested, at least ten (10) days prior to the date of the hearing. (5) The board shall thereafter meet at the time and place set forth in its order and enter upon a hearing upon the complaint and may take appropriate action up to and including an order that the license of the electrician in question be suspended or revoked. (6) The board shall cause a copy of its final order to be served upon the electrician in question by certified mail, return receipt requested, and shall file a copy of its order with the building official. (7) In each case where the chairman of the board has received a complaint which in the unanimous opinion of the board sets forth allegations which would cause immediate danger to life or property, the board may enter an order temporarily suspending the license of the electrician named in the complaint for a period of time not to exceed thirty {30) days. In every case where the board enters a temporary order of suspension as herein authorized, the board shall enter upon its final hearing on the merits of the complaint prior to the expiration of the temporary order of suspension. {8) In every case where an electrician has had his license suspended by order of the board, he shall not be eligible to undertake any electrical work within the City of Lubbock during the term of the suspension set forth in the board's order. At the conclusion of the term of -2- suspension, the electrician•s license shali automatically be reinstated in accordance with the provisions of this Code and he may once again undertake electrical work within the City of Lubbock. (9) In every case where an electrician has had his license revoked by order of the board, he shall not be eligible to undertake any electrical work within the City of Lubbock until such time as he has successfully qualified for a new license as provided in this article. Any electrician whose license has been revoked shall be ineligible to apply for a new license for a period of one (1) year from the date of the order of the board revoking his license. SECTION 2. THAT Section 2-458 of the Code of Ordinances of the City of Lubbock BE and is hereby amended to read as follows: Sec. 2-458. Finality of decision. The decision of the board of electrical examiners to revoke, suspend or refuse to grant an electricians license or any other decision of the board rendered in accordance with this article shall be final and binding. SECTION 3. THAT Subsections (a) and (b) of Section 6-136 of the Code of Ordinances of the City of Lubbock BE and are hereby amended to read as follows: (a) In every case where the chief of the fire department of the City of Lubbock or its fire marshal determines that a fire originated due to any of the following causes: (1) faulty electrical wiring; (2) overloading of electrical equipment; (3) unauthorized electrical installation; or (4) if a fire originating from any cause results in damage to an electrical system; it shall be the duty of the fire chief or fire marshal to have the premises involved fully inspected by the building official. (b) In every case where the building official finds that a fire has caused damage to an electrical system or finds that a fire has originated for any of the reasons set forth in this section, no electrical service shall be reinstalled or reconnected to the property by any electrician or by the owner of such property or any other person until such time as such system has been repaired in compliance with this Code. All inadequate, substandard or hazardous electrical conditions shall be repaired to meet present code requirements and be approved by the building official. -3- SECTION 3. THAT Subsections (1) and (3) of Section 6-156 of the Code of Ordinances of the City of lubbock BE and are hereby amended to read as follows: (1) Master electrician's license qualifying the holder of such license to advertise, bid on electrical work, solicit electrical work, install, maintain and repair all types of electrical equipment and to undertake any and all types of electrical work and to make contracts to perform such work. A person holding this license shall directly supervise all jobs under his permit including personal supervision of journeymen and apprentice electricians working under his permit. A person holding this license shall not be qualified to undertake the work of a master sign electrician, except that a person holding this license may undertake repairs and power connections on a sign. (3) Journeyman electrician's license qualifying the holder to undertake electrical work as defined in Section 6-122(6) of this code as an employee of and directly under the supervision of a licensed master electrician doing electrical work for the general public who will supervise his work on a daily basis. A journeyman electrician working under the supervision of a · licensed master electrician may supervise other journeymen electricians or apprentice workers. SECTION 4. THAT Subsection (1) of Section 6-157 of the Code of Ordinances of the City of lubbock BE and is hereby amended to read as follows: (1) He shall be a high school graduate or the equivalent and shall have four (4) years of apprentice level experience and four (4) years of journeyman level experience under a master electrician providing electrical work for the general public. (a) The four (4) years of journeyman level experience required for a master electrician's license shall be work that is performed directly under the personal supervision of a master electrician on a daily basis. The master electrician must be in the business of general electrical contracting involving all types of electrical work for the general public. (b) The term 11 general public" shall mean performing electrical work of all types on a contract basis, including, but not limited to residential, commercial, industrial and any other type of electrical work in either public or private structures. (c) Work performed for one specific employer who does not contract for all types of electrical work with the general public shall only qualify an electrician for an 11 in house" license as provided by this Code. -4- (d) In its determination of qualifications for a master electrician's license, the board of electrical examiners may require experience including, but not limited to, wiring of residential, commercial and industrial buildings; plan reading, bidding, contract writing, supervising, permitting and any other type of related activity covered under the NEC and the City electrical code. SECTION 5. THAT subsections (a){2) and (a}{4} of Section 6-159 of the Code of Ordinances of the City of Lubbock BE and are hereby amended to read as follows: {2) He shall have five {5} years experience as a full-time apprentice in electrical construction under a licensed master electrician performing electrical construction work for the general public; or {4) He shall have four {4) years of full-time experience under a licensed master electrician working on electrical construction for the general public and possess a certificate of completion from a United States Labor Department approved apprentice program {applicants may be allowed to take the test for this license after completion of seven thousand {7,000) hours of full-time experience under a master electrician performing electrical construction work for the general public, however, the license shall not be issued until the applicant completes the apprentice program hereinabove mentioned}; and SECTION 6. THAT Section 6-247 of the Code of Ordinances of the City of Lubbock BE and is hereby amended to read as follows: Sec. 6-247. Existing Wiring. {a} When additions to or alterations of existing wiring are made in either residences or commercial buildings, all such wiring shall have over-current protective devices installed for the existing wire sizes in accordance with the requirements of this article and the National Electrical Code. (b) When new or additional wiring, circuits, fixtures, appurtenances or appliances are to be added in or about any building or structures making it necessary to abandon any of the existing electrical components so that such components are no longer a part of the working electrical system, such electrical components shall be removed from the building or structure. EXCEPTION: The building official may approve part or all of these components to remain if proof is provided that future use is planned for these components and if all of the unused components are left in such a state as not to violate electrical codes and are completely disconnected from any power source. -s- SECTION 7. THAT Section 6-248 of the Code of Ordinances of the City of Lubbock BE and is hereby amended by adding thereto a new Subsection (d) which shall read as follows: (d) On new installations a three-phase power panel served with a 120/240 volt feeder that is delta connected so that one of the phase to neutral connections will result in a voltage greater than 120 volts (high leg), unused spaces on the panel buss shall be left in a state that would make it difficult to install a single pole breaker serving a line to neutral load on the high phase. SECTION 8. THAT violation of any provision of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars ($200.00) as provided by Section 1-4 of the Code of Ordinances of the City of Lubbock. SECTION 9. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 10. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method of publication provided by law.
