AN ORDINANCE CREATING THE POSITION OF CITY MARSHAL OF THE CITY OF
LUBBOCK, TEXAS, PURSUANT TO SECTIONS 26.041 AND 141.004 OF THE LOCAL
GOVERNMENT CODE OF THE STATE OF TEXAS AND ARTICLE 11, SECTION 5, OF THE
TEXAS CONSTITUTION; PROVIDING FOR PERFORMANCE OF ASSIGNED DUTIES BY ONE
OR MORE CITY MARSHALS; PROVIDING FOR PAY FOR ONE OR MORE CITY MARSHALS;
AND PROVIDING A SAVINGS CLAUSE.
WHEREAS, a home-rule municipality may create offices, determine the
method of selecting officers, and prescribe the qualifications, duties
and tenure of office of officers pursuant to Section 26.041 of the local
Government Code; and
WHEREAS, the governing body of a home-rule municipality may set the
amount of compensation for officers of the municipality pursuant to
Section 141.004 of the local Government Code; and
WHEREAS, the City Council of the City of lubbock, a home-rule
municipality, deems it to be in the best interest of the health, safety
and welfare of the citizens of the City of lubbock to create the position
of city marshal of the City of lubbock; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT there is hereby created the position of city
marshal of the City of lubbock, which position may be occupied by one or
more persons as provided for by the annual City of Lubbock Budget and
approved by the lubbock City Council; and
SECTION 2. THAT the duties of such city marshals shall be as is
specified by the annual City of Lubbock Budget and approved by the
lubbock City Council, including service of process for the Municipal
Courts of Record as provided by Art. 45.04 of the Texas Code of Criminal
Procedure; and
SECTION 3. THAT the pay of such city marshals shall be as is
specified by the annual City of lubbock Budget and approved by the Lubbock City Council; and
SECTION 4. THAT such persons as are appointed city marshals shall
not be deemed officers of the City of Lubbock, but shall be employees of the City of Lubbock; and
SECTION 5. THAT such persons as are appointed city marshals shall
be peace officers under applicable laws of the State of Texas and this
Ordinance, but they shall not be members of the City of Lubbock Police

Department or appointed pursuant to the civil service laws of the State
of Texas.
SECTION 6. THAT should any paragraph, sentence, clause, phrase or
word of this Ordinance be declared unconstitutional or invalid for any
reason, the remainder of this Ordinance shall be unaffected thereby.
AND IT IS SO ORDERED.
