ORDINANCE NO. ·-'9278 _.;;...:;.;.~------ AN ORDINANCE ABANDONING AND CLOSING A PORTION OF A UTILITY EASEMENT IN LOT 3, CAMELOT ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY OF LUBBOCK TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that a portion of the utility easement as hereinafter described in the body of this Ordinance is no longer needed for public use and it would be in the public interest to close, vacate and abandon the same; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT a portion of the utility easement as hereinafter described shall BE and the same is hereby closed, vacated and abandoned for easement purposes and for public use; A portion of a 25 foot utility easement located in Lot 3, Camelot Addition to the City of Lubbock, Lubbock County, Texas, being further described as follows: BEGINNING at a point which bears South a distance of 188.7 feet and East a distance of 24.39 feet from the original Northwest corner of Lot 3, Camelot Addition to the City of Lubbock, Lubbock County, Texas; THENCE East, along the North wall of a metal building, a distance of 0.7 feet to a point; THENCE South, along said East line of 25 foot utility easement, a distance of 250.2 feet to a point; · -~· ~ THENCE West, along the South wall of a metal building, a distance of 0.4 feet to a point; THENCE N. 00°03'43" W., along the West wall of a metal building, a distance of 250.2 feet to the POINT OF BEGINNING. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to indicate said abandonment and closing, showing the number of this Ordinance and the date of its final passage. • 'l SECTION 3. THAT should any section, paragraph, sentence, phrase, <- clause or word of this Ordinance be declared unconstitutional or' invalid for any reason, the remainder of this Ordinance shall'not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
