AN ORDINANCE ESTABLISHING THE PRIMA FACIE SPEED LIMITS ON PORTIONS OF
ERSKINE STREET, AS HEREINAFTER MORE PARTICULARLY DESCRIBED IN THE BODY OF
THIS ORDINANCE; DIRECTING PLACEMENT OF SIGNS WITH RESPECT THERETO; REPEALING
CONFLICTING ORDINANCES TO THE EXTENT OF SUCH CONFLICT; LIMITING
APPLICABILITY OF THE ORDINANCE TO ONLY THOSE STREETS OR HIGHWAYS NAMED
HEREIN; DECLARING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A
PENALTY; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION.
WHEREAS, the governing body of the City of Lubbock, upon the basis of
an engineering and traffic investigation, finds it necessary to establish
prima facie speed limits pursuant to Article 6701d, Vernon's Annotated Civil
Statutes, within the areas and the locations named and designated in the
body of this Ordinance, all within the corporate limits of the City of
Lubbock; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the prima facie speed limits on the following streets
and highways in the urban district set forth below are hereby established
and changed as hereinafter set forth upon the following described portions
of streets and/or highways located within the City of Lubbock, Lubbock
County, Texas, to-wit:
A 55 MPH speed limit zone on Erskine Street between North Quaker
Avenue and North Milwaukee Avenue.
SECTION 2. THAT all Ordinances or parts of Ordinances conflicting
with any of the provisions hereof are hereby repealed insofar as such
conflict exists.
SECTION 3. THAT all highways or streets not specifically set forth in
the preceding sections hereof shall not be affected by the provisions
hereof, and this Ordinance shall be cumulative of all other prima facie
speed limit Ordinances except those with which it specifically conflicts.
SECTION 4. THAT the City Manager is hereby authorized and directed to
cause the placing and maintenance of such traffic control signals and/or
devices and/or signs as shall be necessary to apprise the public of the zone
as hereinabove set forth.
SECTION. 5. THAT violation of any provbions of this Ordinance shall
be deemed a misdemeanor punishable by a fine not to exceed two hundred
dollars ($200.00} as provided in Section 1-4 of the City Code.
SECTION 6. THAT should any paragraph, sentence, clause, phrase or
word of this Ordinance be declared unconstitutional or invalid for any
reason, the remainder of this Ordinance shall not be affected thereby.
SECTION 7. THAT the City Secretary is hereby authorized to cause
publication of the descriptive caption of this Ordinance as an alternative
method provided by law.
AND IT IS SO ORDERED.
