Zone Case 2625 - 01/12/1989II DGV:js First Reading January 12, 1989 Item #10 Second Reading January 26, 1989 Item 10 ORDINANCE NO. 9251 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 2625; A ZONING CHANGE FROM R-1 TO C-3 ZONING ON A TRACT OUT OF SECTION 3, BLOCK E-2, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, safety and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amend- ment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 29-29 of the Code of Ordi- nances, City of Lubbock, Texas, as well as notices provided by Section 211.007(c), Texas Local Government Code, and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on·such proposed amendment, and the public hearing according to said notice was duly held in the City Council Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 2625 SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: A change of zoning from R-1 to C-3 zoning district, under provisions of Section 29-29 of the Code of Ordinances of the City of Lubbock, on a tract out of Section 3, Block E-2, City of Lubbock, Lubbock County, Texas, located at the Southeast corner of 4th Street and Slide Road, subject to conditions and being further described as follows: METES AND BOUNDS DESCRIPTION for a 6.42 acre tract out of Tracts 3 and 4, C. C. Lane Tracts, a subdivision of the North 120 acres of the West Quarter of Section 3, Block E-2, Lubbock, Lubbock County, Texas, being further described as follows: BEGINNING at the Northwest corner of this tract from whence the North- west corner of Section 3 bears S. 89°54' West, a distance of 45.00 feet; THENCE N. 89°54' E. along the North line of Section 3 in the center- line of FM Road 2255, a distance of 587.00 feet to the Northeast corner of this tract; THENCE South at 60 feet pass a 1" square iron tube set in the South right-of-way line of FM Road 2255, continuing along the West right-of- way line of York Avenue, a total distance of 357 feet to a 1" square iron tube set in the South right-of-way line of 5th Street; THENCE East along the South right-of-way line of 5th Street, a dis- tance of 28 feet to a 3/8" iron rod found as the Northwest corner of lot 849, Pleasant Ridge Addition; THENCE South along the East line of Tract 3, a distance of 119.50 feet to a 1/211 iron pipe found as the Southwest corner of lot 849, Pleasant Ridge Addition; THENCE West along the North line of a previously dedicated 20 foot alley, a distance of 394.83 feet to a 1/211 iron pipe found as a corner of this tract; THENCE N. 82°32' W. along the North line of a previously dedicated 20 foot alley, a distance of 186.69 feet to a 1/211 iron pipe found as a corner of this tract; THENCE West along the North line of a previously dedicated 20 foot alley, a distance of 35.06 feet to a 1/2" iron pipe found as the Southwest corner of this tract; THENCE North along the East right-of-way line of Slide Road at 391.22 feet pass a 1" square iron tube set in the South right-of-way line of FM Road 2255, continuing for a total distance of 451.22 feet to the PLACE OF BEGINNING. SUBJECT TO THE FOLLOWING CONDITIONS: a. That a seven (7) foot masonry fence shall be constructed immedi- ately South of the approximate 17,750 square foot strip center and a masonry or combination brick pier/wood insert fence shall be required on the remainder of the South property line, adja- cent·to the existing duplex, and between the curb cuts off York Avenue. b. That a 25 foot setback shall be required on the South property line and that the setback shall be as drawn on the preliminary site plan on the East property line. - 2 - c. That no incinerators, motors, or compactors shall be located on the South side of the buildings. d. That a site plan, including building elevations showing mate- rials, color and texture shall be submitted and approved by the Planning and Zoning Commission prior to the issuance of a Build- ing Permit. Two weeks prior to the review, the City Staff shall notify the residents within a 200 foot area. SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed One Thousand and No/100 Dollars ($1,000.00) as provided in Section 29-31 of the Zoning Ordi- nance of the City of Lubbock. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any rea- son, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause pub- lication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
