AN ORDINANCE AMENDING ARTICLE VI OF CHAPTER 26 OF THE COD
OF ORDINANCES OF THE CITY OF LUBBOCK., ENTITLED 11COIN•OPERATED
MACHINEStf., BY AMENDING SECTION 26-44 TO PROHIBIT PLAY BY MINORS
UNDER TEN YEARS OF AGE; AMENDING SECTION 26-45 PROVIDING FOR
SIGNS; AMENDING SECTION 26-47 PROVIDING FOR MINOR'S REPRESENTA-
TION OF AGE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLI-
CATION.
WHEREAS~ the City Council has determin~d that the changes in the ordin-
ances governing coin--operated machines, as indicated below, would be in the besi
interest of the citizens of the City of Lubbock; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Section 26-44 of the Code of Ordinances, City of Lub-
bock, BE and is hereby amended to read as follows:
Sec. 26-44. Play by minors prohibited; marble board,
pin ball machines defined. It shall hereafter be unlaw-
ful, in the city, for any person as owner, exhibitor,
leasee., or agent or employee of any owner, exhibitor
or leasee of a marble board or pin ball machine that is
operated by a United States coin or token to permit any
minor under the age of ten (10) years old to play such
marble board or pin ball machine. For the purposes of
this article a marble board or pin ball machine is defined
as any machine or device of skill or amusement where a
ball is propelled by a plunger.
SECTION 2. THAT Section 26-45 of the Code of Ordinances, City of Lub-
bock, BE and is hereby amended to read as follows:
Sec. 26-45. Sign prohibiting play by minors to be affixed
to machine; legend. It shall be the duty of any person in
control of or operating any place of business where such
machines are exhibited to secure or fix a sign on each
such machine to read: "Play by Juvenile under ten (10)
not allowed unless accomnanied bv narent or P-uardian or

SECTION 4. THAT should any section, paragraph, sentence, clause,
phrase or word of this Ordinance be declared unconstitutional or invalid for any
reason, the remainder of this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary is hereby authorized to cause pub-
lication of the descriptive caption of this Ordinance as an alternative method pro-
vided by law.
