WHEREAS, the City Council finds that the portions of street easement as hereinafter described in the body of this Ordinance are no longer needed for public use and it would be in the public interest to close, vacate and abandon the same; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT those portions of street easement as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for street easement purposes and for public use: TRACT 1 A 50.40 square foot tract of land out of Lot 1, Block 10, Nelson Brown Addition, an addition to the City of Lubbock, Lubbock County, Texas and being described by metes and bounds as follows: BEGINNING at the Original Northeast corner of said Lot 1, Block 10, Nelson Brown Addition; ,.·:, THENCE West along the original North line of said Lot 1, Block 10, 87.10 feet to a point; THENCE South, 11.40 feet to a point, the Northeast and BEGINNING CORNER of this tract; THENCE continue South 1.10 feet to a point, in the present South R.O.W. line of 40th Street, the Southeast corner of this tract; THENCE West along the South present R.O.W. line of said 40th Street, 42.0 feet to a point, the Southwest corner of this tract; [VOL3457 PACE 176 THENCE North, 1.3 feet to a point, the Northwest corner of this tract; THENCE S 89°43 1 38" E, 42.0 feet to a point, the BEGINNING CORNER of this tract, TRACT 2 A 61.75 square foot tract of land out of Lot 1, Block 10, Nelson Brown Addition, an addition to the City of Lubbock, Lubbock County, Texas and being described by metes and bounds as follows: BEGINNING at the Original Northeast corner of Nelson Brown Addition; THENCE South along the original East line of said Lot 1, Block 10, 29.'40 feet to a point; THENCE East, 29.10 feet to the Northeast and BEGINNING CORNER of this tract; THENCE S 0°05'17" E, 65.0 feet to a point, the Southeast corner of this tract; THENCE West, 1.0 foot to a point in the present West R.O.W. line of Quirt Avenue, the Southwest corner of this tract; THENCE North along the present R.O.W. line of said Quirt Avenue, 65.0 feet to a point, the Northwest corner of this tract; THENCE East, 0.9 foot to the BEGINNING CORNER of this tract. Said tracts being portions of a street easement dedicated by Pioneer Natural Gas Company dated August 12, 1958 and recorded in Volume 706, Page 413 of the deed records of Lubbock County, Texas. SECTION .2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to indicate said abandonment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. - 2 - • •-I . .... , -- . .,., . ._. .... rvoL3457 PAGE t 77 SECTION 4.
