ORDINANCE NO. 9385
AN ORDINANCE DEFINING TERMS IN RELATION TO EDUCATIONAL INCENTIVE PAY
FOR CIVIL SERVICE MEMBERS OF THE FIRE AND POLICE DEPARTMENTS OF THE CITY OF
LUBBOCK, PROVIDING FOR SUCH INCENTIVE PAY AND THE REQUIREMENTS AND BASIS
THEREFOR, PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION OF THIS
ORDINANCE AND AN EFFECTIVE DATE HEREOF.
WHEREAS, the City Council of the City of Lubbock finds it desirable
and in the public interest and the interest of public safety and welfare to
improve the Police and Fire Departments of said City by granting educational
incentive pay to the Civil Service members of said departments pursuant to
the authority of V.T.C.A., Local Government Code §143.044 as currently
amended and as amended hereafter; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1 .. APPLICABILITY.
A. Provisions of this Ordinance will apply in all matters concern-
ing Educational Incentive Pay, Additional Educational Incentive
Pay and Masters Educational Incentive Pay for Civil Service mem-
bers of the Fire and Police Departments of the City of Lubbock.
B. The previously enacted Incentive Pay Ordinance No. 7543 is
hereby superseded and revoked effective upon the date of ap-
proval of this Ordinance by the City Council of the City of
Lubbock Texas.
SECTION 2. OPTION 1, PROVISIONS AND REQUIREMENTS.
Members who make application and qualify for incentive pay in accor-
dance with requirements of Option l (Sections 2 and 3 of this Ordinance)
prior to December 1, 1990, may receive such pay so long as such requirements
are met, without regard to Option 2 (Sections 4 and 5 of this Ordinance).
The following terms when used in Sections 2 and 3 of this Ordinance
shall have respective meanings as follows:
A. POLICE DEPARTMENT EDUCATIONAL INCENTIVE PAY.
This term shall relate to pay which is offered upon the success-
ful completion of at least 60 semester hours in an accredited college
or university, with a minimum of 12 semester hours in police science
or other related fields of study, such as courses dealing with techni-
cal support and administrative staff services. The phrase "technical
support," as used herein, shall mean fields of study which deal with
criminal laboratory analysis and interpretations, the technical cr1m1-
nal aspects of identification and photography, the technical phases of
police radio communications, and any other field of study relating to
police technical support which is directly related to the proper and
efficient operation of the Police Department, as may be determined by
the Chief of Police and City Manager, or their designated representa-
tives. The phrase 0 administrative staff services," as used herein,
shall mean fields of study which deal with police administration,
police personnel (including nonclassified personnel), and police
training procedures (including basic and in-service training). This
phrase shall also include fields of study which deal with police press
relations, police conununity relations, and any other administrative
field of study which may be directly related to the proper and effi-
cient operation of the Police Department, as may be determined by the
Chief of Police and City Manager, or their designated representatives.
Such courses in police science or other related fields of study may
also include studies in the following specific areas:
1. Police Science
2. Business Administration
3. Public Administration
4. Psychology
5. Sociology
6. Computer Science
B. ADDITIONAL POLICE DEPARTMENT EDUCATIONAL INCENTIVE PAY.
This term shall relate to pay which is offered upon the success-
ful completion of 120 semester hours in an accredited college or
university and the attainment of a bachelor's degree, provided that
such degree is in connection with a major in police science or other
related fields of study as fully described in the subsection 2(A} next
above.
c. FIRE DEPARTMENT EDUCATIONAL INCENTIVE PAY.
This term shall relate to pay which is offered upon the success-
ful completion of at least 60 semester hours in an accredited college
or university with a minimum of 12 semester hours in fire science or
other related field of study, such as courses dealing with technical
support and administrative staff services. The phrase "technical sup-
port," as used herein, shall mean fields of study which deal with fire
suppression, fire prevention, fire prevention education, enforcement
of building, fire, and other codes related to the protection of life
or property, photography, arson or fire investigation, criminal iden-
tification, polygraph training, the technical phases of fire and
emergency radio communications, and any other field of study relating
to fire technical support which is directly related to the proper and
efficient operation of the Fire Department, as may be determined by

the Fire Chief and City Manager, or their designated representatives.
The phrase •administrative staff services," as used herein, shall mean
fields of study which deal with fire administration, fire personnel
(including nonclassified personnel), and fire training procedures (in-
cluding basic and inservice training). This phrase shall also include
fields of study which deal with fire press relations, fire community
relations, and any other administrative fields of study which may be
directly related to the proper and efficient operation of the Fire
Department, as may be determined by the Fire Chief and City Manager,
or their designated representatives. Such courses in fire science or
other related fields of study msY !.ill include studies in the follow-
ing specific areas:
1. Fire Technology
2. Business Administration
3. Public Administration
4. Architecture
5. Chemistry
6. Physics
7. Engineering (Chemical, Electrical, Industrial,
Mechanical, Petroleum)
8. Engineering Physics
9. Engineering Technology
10. Education, Secondary
11. Computer Science
D. ADDITIONAL FIRE DEPARTMENT EDUCATIONAL INCENTIVE PAY
This term shall relate to pay which is offered upon the suc-
cessful completion of 120 semester hours in an accredited college or
university and the attainment of a bachelor's degree, provided that
such degree is in connection with a major in fire science, fire pro-
tection, or any other field of study as fully described in subsection
2(C) next above.
SECTION 3. In order to have continuing eligibility for educational
incentive pay as provided in Section 2 of this Ordinance, members of the
Fire and Police Departments shall comply with the following provisions:
A. After becoming eligible for Police Department Educational Incen-
tive Pay or Fire Department Educational Incentive Pay, each
member of the Fire and Police Departments, in order to continue
such eligibility, is hereby required (within each calendar year
after the year in which such member becomes eligible for such
educational incentive pay) to successfully complete and receive
academic credit for (in an accredited college or university) at
least three semester hours in police science or other related
field of study (as defined in subsection 2(A) above for Police
Department members) or fire science or other related field of

study (as defined in subsection 2(C) above for Fire Department
members).
B. After becoming eligible for additional Police Department Educa-
tional Incentive Pay or Additional Fire Department Educational
Incentive Pay, each member of the Fire and Police Departments,
in order to continue such eligibility, is hereby required
(within each two calen_dar year period after the year in which
such member becomes eligible for such additional educational
incentive pay) to successfully complete and receive academic
credit (in an accredited college or university) for at least
three semester hours in police science or other related field
of study (as defined in subsection 2(A) above for Police Depart-
ment members) or fire science or other related field of study
(as defined in subsection 2(C) above for Fire Department
members).
C. In any said calendar year in which such eligibility for Police
Department Educational Incentive Pay or Fire Department Educa-
tional Incentive Pay is not continued by compliance by any
particular member of the Fire or Police Departments, such
member's incentive pay shall terminate on December 31 of the
calendar year in which such eligibility was not continued.
D. In any said two calendar year period in which such eligibility
for Additional Police Department Educational Incentive Pay or
Additional Fire Department Educational Incentive Pay is not
continued by compliance by any particular member of the Fire or
Police Departments, such member's incentive pay shall terminate
on December 31 of the last year of such two calendar year
period.
E. If any member of the Fire or Police Departments fails to meet
the requirements of continuing eligibility for Additional Fire
Department Educational Incentive Pay or Additional Police De-
partment Educational Incentive Pay and thereby is not eligible
for such pay, then in such event such member shall also lose
eligibility for Fire Department Educational Incentive Pay or
Police Department Educational Incentive Pay.
F. Eligibility for Police Department Educational Incentive Pay or
Fire Department Educational Incentive Pay, and/or Additional
Police Department Educational Incentive Pay or Additional Fire
Department Educational Incentive Pay may be re-established one
year after the date of loss of eligibility by said member of the
Fire or Police Department successfully completing and receiving

credit for three semester hours in an accredited college or
university for study of the type hereinabove required for con-
tinuing eligibility for such incentive pay.
SECTION 4. OPTION 2, PROVISIONS AND REQUIREMENTS.
Members who qualify for incentive pay in accordance with requirements
of Option 2 (Sections 4 and 5 of this Ordinance) may receive such pay with-
out regard to Option 1 (Sections 2 and 3 of this Ordinance).
The following terms when used in Sections 4 and 5 of this Ordinance
shall have respective meanings as follows:
A. Accredited college or university shall mean a college or univer-
sity accredited by one or more of the following agencies, or by
such other accrediting agencies having similar academic creden-
tials and standards as may be deemed acceptable by the Police
Chief or Fire Chief (as appropriate) and the City Manager.
B.
New England Association of Schools and Colleges, Comission on
Institutions of Higher Education (NEASC).
New England Association of Schools and Colleges, Commission on
Vocational, Technical, Career Institutions (NEASC).
Middle States Association of Colleges and Schools, Commission on
Higher Education (MSA/CHE).
North Central Association of Colleges and Schools, Comission on
Institutions of Higher Education (NCA).
Northwest Association of Schools and Colleges, Comission on
Colleges (NASC).
Southern Association of Colleges and Schools, Commission on
Colleges (SASC/CC).
Western Association of Schools and Colleges, Accrediting Commis-
sion for Senior Colleges and Universities (WASC).
Western Association of Schools and Colleges, Accrediting Commis-
sion for Community and Junior Colleges (WASC-J).
New York State Board of Regents.
POLICE DEPARTMENT EDUCATIONAL INCENTIVE PAY.
This term shall relate to pay which is offered upon the successful
completion of at least 60 semester hours in an accredited college or univer-

I sity, with a minimum of 30 semester hours in courses approved by the Police
Chief and City Manager, or their designated representatives. The required
30 semester hours must be from course areas listed below:
1. Accounting
2. Business Administration
3. Computer Science
4. Criminal Justice
5. Education
6. Forensic Sciences
7. Government
8. Law 9. Law Enforcement
10. Management
11. Mass Communications
12. Police Science
13. Political Science
14. Psychology
15. Public Administration
16. Public Relations
17. Sociology
18. Spanish
C. ADDITIONAL POLICE DEPARTMENT EDUCATIONAL INCENTIVE PAV.
This term shall relate to pay which is offered upon the successful
completion of 120 semester hours in an accredited college or university and
the attainment of a bachelor's degree, with a minimum of 30 semester hours
in courses approved by the Police Chief and City Manager, or their desig-
nated representatives. The required 30 semester hours must be from course
areas listed in subsection 4(8) above.
D. MASTERS POLICE DEPARTMENT EDUCATIONAL INCENTIVE PAV.
This term shall relate to pay which is offered upon the successful
completion of 150 semester hours in an accredited college or university and
the attainment of a masters degree. The masters degree must be in a field
approved as relevant to police service by the Police Chief and City Manager
or their designated representatives. Masters degrees in such fields as
Public Administration or Business Administration will be approved.
E. FIRE DEPARTMENT EDUCATIONAL INCENTIVE PAV.
This term shall relate to pay which is offered upon the successful
completion of at least 60 semester hours in an accredited college or univer-
sity, with a minimum of 30 semester hours in courses approved by the Fire
Chief and City Manager, or their designated representatives. The required
30 semester hours must be from course areas listed below:

7. Oral Comunications
8. Accounting
9. Engineering
10. Physics
11. Computer Science
12. Architecture
13. Economics
14. Chemistry

F. ADDITIONAL FIRE DEPARTMENT EDUCATIONAL INCENTIVE PAY
This term shall relate to pay which is offered upon the successful
completion of 120 semester hours in an accredited college or university and
the attainment of a bachelor's degree, with a minimum of 30 semester hours
in courses approved by the Fire Chief and City Manager, or their designated
representatives. The required 30 semester hours must be from course areas
listed in subsection 4(E) above.
G. MASTERS FIRE DEPARTMENT EDUCATIONAL INCENTIVE PAY
This term shall relate to pay which is offered upon the successful
completion of 150 semester hours in an accredited college or university and
the attainment of a masters degree. The masters degree must be in a field
approved as relevant to the fire service by the Fire Chief and City Manager,
or their designated representatives. Masters degrees in such fields as
Public Administration or Business Administration will be approved.
SECTION 5. OPTION 2, ACCEPTABILITY OF COURSE CREDITS.
Course credits granted by colleges or universities for "prior learning
assessment," •experiential learning," prior military experience, prior work
experience, or courses sponsored and paid for by the City of Lubbock will
not be acceptable as a part of the 60 semester hours required for Educa-
tional Incentive Pay, nor as a part of the 30 semester hours in specified
course areas required for Educational Incentive Pay or Additional Educa-
tional Incentive Pay.

SECTION 6. Educational incentive pay for Civil Service members of the
Fire and Police Departments shall be at such rates as established in the
City budget and approved by the City Council.
SECTION 7. It is hereby determined that the City of Lubbock, Texas,
has a population of over 20,000, and this Ordinance is passed pursuant to
the authority of the V.T.C.A., Local Government Code §143.044 as currently
amended and as amended hereafter.
SECTION 8. In accordance with said §143.044, the provisions of this
Ordinance relating to incentive pay shall be inapplicable in every particu-
lar to the Police Chief and Fire Chief.
SECTION 9. THAT should any section, paragraph, sentence, clause,
phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby.
SECTION 10. THAT the City Secretary is authorized and directed to
cause the publication of the descriptive caption of this Ordinance as an
alternative method of publication as provided by law, once a week for two
consecutive weeks in a newspaper regularly published in the City of Lubbock,
I and this Ordinance shall become effective ten days after its last publica-
tion.
