August 23, 1990 Item #J4 ORDINANCE NO. 9373 AN ORDINANCE AMENDING SECTION 26-22, SUBSECTION (b)(2) OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO ALLOCATION OF HOTEL OCCUPANCY TAX REVENUES; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council of the City of Lubbock deems it to be in the best interest of the citizens of the City of Lubbock to change the hotel occupancy tax allocations as currently reflected in Section 26-22 of the Code of Ordinances; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Subsection (b)(2) of Section 26-22 of the Code of Ordinances of the City of Lubbock, Texas, be amended to read as follows: (2) The funds received from the tax levied under Subsection (a) shall be distributed as follows: Reserve for arts and related items ...... 1/2 cent Debt service for convention center facilities .............. . . 2 1/4 cents . 3 1/4 cents . . 4/10 cent Convention and tourism activities .. . General fund for civic center operations . Reserve for special projects •••. Reserve for convention and tourism . . 1/10 cent capital projects • . . • • . . . . • . 1/4 cent Convention and tourism incentive ......• 1/4 cent SECTION 2. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. / - SECTION 3. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an al- ternative method of publication provided by law. THAT Subsection 26-22(b)(2) of the Code of Ordinances of the City of Lubbock, Texas, be amended to read as follows: (2) The funds received from the tax levied under subsection (a) shall be distributed as follows: Culture/Leisure facility Renovation & debt Civic Center Renovation Historic preservation & restoration Ft Worth & Denver Depot Civic Center Marketing Convention & Tourism Bureau Lubbock Arts Alliance Municipal Arts Administration Visitor Information Center Depot Inbound Tourist Travel airport Visiting Participatory & Spectator Sports Tourism reserve fund 18.58 percent8 8.19 percent 42.86 percent 5. 71 percent 5. 71 percent 2.87 percent 1. 07 percent 11.43 percent 3.57 percent 8upon expiration of civic center renovation debt, funds will be used to pay debt on the preservation and restoration of Ft. Worth & Denver Depot. Upon expiration of Ft. Worth & Denver Depot debt, funds will continue to be used to offset museum marketing. State law allows for up to 15 % of tax collected used for arts related projects and 15% of tax collected for historic preservation, restoration projects or promotions to encourage tourist and convention delegates to visit preserved historic sites or museums. SECTION 2. THAT should any paragraph, section, sentence, clause, phrase of word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. 1 SECTION 3.
