HomeMy WebLinkAboutOrdinance - 9348-1990 - Amending Chapter 2 Article X Of The Code Of Ordinances - 03/22/1990HW:da First Reading March 22, 1990 Item #7 Second Reading April 12, 1990 Item #12 ORDINANCE NO. 9348 AN ORDINANCE AMENDING CHAPTER 2, ARTICLE X OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, BY ADDING THERETO SECTIONS 2-270 THROUGH 2- 272 WHICH CREATE AND ESTABLISH AN ADVISORY COMMITTEE TO THE PARK AND RECREATION BOARD OF THE CITY OF LUBBOCK AND OUTLINE THE DUTIES AND COMPOSITION OF SUCH COMMITTEE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council of the City of Lubbock has determined that there is a public need for the creation of an advisory committee to the park and recreation board composed of individuals who represent organizations that utilize the Municipal Garden and Arts Center; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAtthapter 2, Article X of the Code of Ordinances of the City of Lubbock BE and is hereby amended by adding thereto Sections 2- 270 through 2-272, which shall read as follows: Sec. 2-270. Municipal Garden and Arts Center Advisory Committee Established. There is hereby created and established an advisory committee to the park and recreation board to be known as the municipal garden and arts center advisory committee. Sec. 2-171. Duties of Advisory Committee. The municipal garden and arts center advisory committee shall make recommendations to the park and recreation board concerning the operations and activities of the Municipal Garden and Arts Center and promote use of the facility so as to afford all citizens an opportunity to benefit from the fullest realization of Lubbock's cultural and educational resources. In conjunction with these responsibilities, the advisory committee shall review the Municipal Garden and Arts Center's rental rates, fundraising practices, exhibition policies, and long-range capital improvement programs. Sec. 2-272. Composition of the Advisory Committee. (a) The advisory committee shall consist of nine (9) members, each of whom shall be appointed by the City Council from the membership of organizations who utilize the Municipal Garden and Arts Center. The park and recreation board shall make recommendations to the City Council regarding such appointments. {b) The advisory committee shall meet as often as necessary to fulfill the duties set forth in Sec. 2-271 of this Chapter. A majority of committee members shall constitute a quorum. {c) The advisory committee shall elect one of its members as chair and another member as vice chair of the committee. The chair shall preside at all advisory committee meetings which he or she attends and the vice chair shall preside in the absence of the chair. The director of parks and recreation shall serve as an ex-officio member and secretary for the committee and maintain records of all committee meetings. {d) Except as otherwise herein stated, members of the advisory committee shall each be appointed to serve one-year terms. At the end of such year, the City Council shall review the work of the advisory committee to.determine whether a public need for such committee still exists and whether the citizens of Lubbock are best served by the committee continuing to operate as an advisory committee to the park and recreation board. Any member of the advisory committee who fails to attend three (3) consecutive committee meetings for any reason other than sickness, emergency or business reasons, or who fails to attend at least fifty per cent (50%) of such meetings during his or her term shall become disqualified to serve as a committee member; and upon notification from the secretary to the committee that such member has become disqualified, the City Council shall thereupon appoint a successor to complete any unexpired term of the disqualified member. The City Council may also remove any member of the advisory committee for cause by unanimous vote of Council members present at any regularly scheduled Council meeting. Upon the death, resignation or removal of any committee member for cause, the City Council shall appoint a successor to complete any unexpired term of the member whose death, resignation or removal for cause created a vacancy. (e) In addition to the director of parks and recreation, the city manager may appoint as many ex-officio members of the committee as he deems advisable, none of whom shall be entitled to vote at committee meetings. (f) No committee member shall receive any salary or other compensation from the City for serving as a committee member. - 2 - SECTION 2.· THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 3. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
