March 22, 1990 Item #16 Se~ond Reading April 12, 1990 Item #8 [VOL 3321 PAGE 334 [VOL 3333 PACE 168 ORDINANCE NO. 9344 ---- AN ORDINANCE ABANDONING AND CLOSING PORTIONS OF A STORM WATER DRAINAGE AND STORAGE EASEMENT LOCATED IN SOUTHWEST COMMERCIAL PARK ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY OF LUBBOCK TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that those portions of the storm water drainage and storage easement as hereinafter described in the body of this Ordinance are no longer needed for public use and it would be in the public interest to close, vacate and abandon the same; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION I. THAT those portions of the storm water drainage and storage easement as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for easement purposes and for public use, to wit: Tract 1 A portion of a storm water storage and drainage easement located on Lot 3, Southwest Commercial Park Addition to the City of Lubbock, Lubbock County, Texas, being further described as follows: BEGINNING at a point which bears South 248.79 feet and East 130.43 feet from the Northwest corner of Lot 3, Southwest Commercial Park Addition to the City of Lubbock, Lubbock County, Texas; THENCE East a distance of 18.96 feet; THENCE S. 62°24'10" W. a distance of 16.95 feet; THENCE N. 26°35'50" W. a distance of 8.49 feet to the POINT OF BEGINNING. THIS INSTRUMENT IS BEING REFILED TO CORRECT A MISTAKE IN THE LEGAL DESCRIPTION OF TRACT 2 • Tract 2 rvoL 3321 PAGE 335 £"VOL 3333 PACE 169 A portion of a storm water storage and drainage easement located on Lots 2 and 3, Southwest Commercial Park Addition to the City of Lubbock, Lubbock County, Texas, being further described as follows: BEGINNING at a point which bears South 248.79 feet from the Northwest corner of Lot 3, Southwest Commercial Park Addition to the City of Lubbock, Lubbock County, Texas; THENCE East a distance of 14;on-feet; THENCE South a distance of 21.45 feet; THENCE West a distance of 16.50 feet; THENCE North a distance of 21.45 feet; THENCE East a distance of 2.50 feet to the POINT OF BEGINNING. Tract 3 A portion of a storm water storage and drainage easement located on Lot 3, Southwest Commercial Park Addition to the City of Lubbock, Lubbock County, Texas, being further described as follows: BEGINNING at a point which bears S. 36°04'45" E., 28.00 feet from the Northeast corner of Lot 3, Southwest Commercial Park Addition to the City of Lubbock, Lubbock County, Texas; THENCE S. 36°04'45" E. a distance of 273.00 feet; THENCE S. 53°55'15" W. a distance of 60.00 feet; THENCE N. 30°09'46" W. a distance of 194.03 feet; THENCE N. 18°12'06" W. a distance of 65.15 feet; THENCE N. 11°55'38" E. a distance of 26.91 feet to the POINT OF BEGINNING. SECTION 2. THAT the City Engineer shall mark the official maps of the City of Lubbock to indicate said abandoning and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby.
