WHEREAS, the City Council of the City of Lubbock has determined it to be in the best interest of the citizens of the City of Lubbock to modernize and revise civic center operating procedures to reflect current practices and procedures; NOY THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Division 1 of Article IV of Chapter 2 of the Code of Ordinances of the City of Lubbock, Texas, BE and the same is hereby amended to read as follows: DIVISION l. GENERALLY Sec. 2-77. Definition; board. (a) For the purpose of this article, the term "civic center" shall encompass the present auditorium-coliseum, the memorial civic center and any future civic centers, auditoriums or coliseums. (b) The City Council of the City of Lubbock shall be advised by a civic centers advisory board with regard to civic centers operations to the extent set out in this article. In addition, the municipal auditorium-coliseum shall be operated in accordance with any operating agreement in effect between the City and Texas Tech University. Sec. 2-78. Insurance. Prior to any public use of the civic centers, adequate insurance shall be provided insuring the City against claims of any character for personal injury or loss sustained in, on or about any civic centers premises, excepting therefrom employees of the City while on duty. Such insurance, as may be required by the City, shall be provided. SECTION 2. THAT Division 2 of Article IV of Chapter 2 of the Code of Ordinances of the City of Lubbock, Texas, BE and the same is hereby amended to read as follows: DIVISION 2. CIVIC CENTERS BOARD Sec. 2-93. Created; designation; composition. There is hereby created and established a civic centers advisory board to be composed of fifteen (15) members, all of whom shall be resident citizens of the City and one of whom shall be a representative of Texas Tech University. The Board shall be officially designated the "Lubbock Civic Centers Board." Sec. 2-94. Appointment and terms of members. (a) The members of the Board shall be appointed by the City Council and shall hold office for a term of three (3) years or until a successor is appointed. (b) The appointment of the representative of Texas Tech University, as provided for in the preceding section, shall be subject to the approval of the President of Texas Tech University. Sec. 2-95. Ex officio members. The City Council shall, by resolution, designate such officers of the City as it deems advisable to be ex officio members of the Board, without voting privileges and who shall act in an advisory capacity; provided, however, that the civic center director and a person designated by the City Manager shall be included as ex officio members. Sec. 2-96. Officers; records. The Board shall appoint one of its members as chairperson and one of its members as vice chairperson. It shall be the duty of the chairperson to preside at all meetings of the Board and the vice chairperson shall preside in the absence of the chairperson. The civic centers director shall be the secretary of the Board and shall keep permanent records of all proceedings of the Board, which records shall be delivered to the City Secretary for retention purposes. Sec. 2-97. Meetings. The Board shall meet as needed to consider recommendations to the City Council pertaining to the operation of the civic centers facilities. - 2 - Sec. 2-98. Recommendations; quorum; subcommittees; executive committee. Any and all recommendations made by the Board to the City Council shall be made by the concurring vote of at least eight (8) members of the Board. A majority of the total membership of the Board shall constitute a quorum for the transaction of all matters to be considered by the Board. The Board is authorized to establish subcommittees for specific functions with a chairperson for each, the subcommittee chairpersons shall constitute the executive committee of the Board to transact all routine and emergency business. Sec. 2-99. Powers and duties generally. The Board shall make recommendations to the City Council pertaining to: 1) use of the facilities; 2) operation of the facilities; 3) rental rates,·based on reviews and research, at least once each year; 4) short and long range planning pertaining to restoration, renovations and/or capital improvement programs; 5) the largest and most reasonable use of the facilities consistent with the public interest; and 6) other recommendations as deemed advisable by the Board or requested by the City Council. The Board shall have the authority to promulgate reasonable rules and regulations, subject to the approval of the City Council. No free use of the buildings shall be permitted, extended or granted to any individual, organization or group, except City uses duly authorized by the City Council. Sec. 2-100. Vacancies; removal. Upon the death, resignation, removal or expiration of the term of office of any of the members of the Board, the City Council shall appoint a successor to the Board, who shall hold membership on the Board for the unexpired term of the member he is appointed to succeed, or for the period of three (3) years when the appointment is made due to expiration of a member's term. In the event the best interests of the City require the removal of a member of the Board, removal of such member shall be accomplished by appointment of a successor by the City Council. SECTION 3. THAT Division 3 of Article IV of Chapter 2 of the Code of Ordinances of the City of Lubbock, Texas, BE and the same is hereby repealed in its entirety. SECTION 4. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. - 3 - - SECTION 5. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method of publication provided by law.
