ORDINANCE NO. 9339
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF
THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 1153-J; A
ZONING CHANGE FROM C-3 SPECIFIC USE TO C-3 ZONING AND TO ALLOW A 43' SETBACK
FROM STREET PROPERTY LINES ON TWO TRACTS OUT OF LOTS BAND C, SECURITY PARK
DEVELOPMENT ADDITION, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDING A
PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS, the proposed changes in zoning as hereinafter made have been
duly presented to the Planning and Zoning Commission for its recommendation
which was received by the City Council and, after due consideration, the City
Council finds that due to changed conditions, it would be expedient and in
the interest of the public health, safety and general welfare to make those
proposed changes in zoning; and
WHEREAS, all conditions precedent required by law for a valid amendment
to the Zoning Ordinance and Map have been fully complied with, as well as
giving notices in compliance with Section 29-29 of the Code of Ordinances,
City of Lubbock, Texas, as well as notices provided by Section 211.007(c),
Texas .Local Government Code, and notice was duly published in the Lubbock
Avalanche-Journal more than fifteen (15) days prior to the date of the public
hearing before the City Council on such proposed amendment, and the public
hearing according to said notice was duly held in the City Council Chamber of
the Municipal Building, Lubbock, Texas, at which time persons appeared in
support of the proposal; and, after said hearing, it was by the City Council
determined that it would be in the public interest, due to changed condi-
tions, that the Zoning Ordinance and the Zoning Map be amended in the manner
hereinafter set forth in the body of this Ordinance and this Ordinance having
been introduced prior to first reading hereof; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
ZONE CASE NO. 1153-J
SECTION l. THAT Ordinance No. 7084 and the Official Zoning Map BE and
the same are hereby amended as follows, to-wit:
A change of zoning from C-3 Specific Use to C-3 zoning district, under
provisions of Section 29-29 of the Code of Ordinances of the City of
Lubbock, and to allow a minimum 43 foot setback from street property
lines on two tracts out of Lots Band C, Security Park Development
Addition, City of Lubbock, Lubbock County, Texas, located at 5211
Brownfield Highway, being subject to conditions and being further
described as follows:
TRACT 1
METES AND BOUNDS DESCRIPTION of a 4.0522 acre tract of land being a
portion of Lot "C," Security Park Development an Addition to the City
of Lubbock, Lubbock County, Texas, being further desribed as follows:
BEGINNING at a cross on concrete which bears West a distance of 1169.87
feet and South a distance of 1319.06 feet from the Northeast corner of
Section 6, Block E-2, Lubbock, Lubbock County, Texas;
THENCE West a distance of 194.02 feet to a 3/8" iron rod found at a
point of curvature;
THENCE Northwesterly around a curve to the right, said curve having a
radius of 229.10 feet, a central angle of 15°58'23", tangent lengths of
32.14 feet and chord distance of 63.66 feet to a 3/8" iron rod found at
a point of reverse curvature;
THENCE Northwesterly around a curve to the left, said curve having a
radius of 496.13 feet, a central angle of 15°38'23", tangent lengths of
69.61 feet and a chord distance of 137.87 feet to a found 3/8" iron
rod;
THENCE West a distance of 218.94 feet to a 3/8" iron rod found at a
point of curvature;
THENCE Southwesterly around a curve to the left, said curve having a
radius of 121.46 feet, a central angle of 36°07'38", tangent lengths of
39.61 feet and a chord distance of 75.32 feet to a 5/8" iron rod set
for a point of reverse curvature;
THENCE Northwesterly around a curve to the right, said curve having a
radius of 15.00 feet, a central angle of 90°, tangent lengths of 15.00
feet and a chord distance of 21.21 feet to a set 5/8" iron rod;
THENCE N. 36°07'38" W. a distance of 76.94 feet to a 5/8" iron rod set
for a point of curvature;
THENCE Northeasterly around a curve to the right, said curve having a
radius of 15.00 feet, a central angle of 90°. tangent lengths of 15.00
feet and a chord distance of 21.21 feet to a set 5/8" iron rod;
THENCE N. 53°52'22" E. a distance of 336.56 feet to a 1/2" iron rod
found at a corner of this tract;
THENCE S. 36°07'38" E. a distance of 50.00 feet to a 5/8" iron rod set
for an interior corner of this tract;

THENCE N. 89°47'40" E. a distance of 220.78 feet to a concrete nail and
shiner set for an interior corner of this tract;
THENCE N. 45°08'14" E. a distance of 196.00 feet to a concrete nail and
shiner set for a corner of this tract;
THENCE S. 44°55'26" E. a distance of 122.01 feet to a 40 penny nail set
in seam of concrete and building wall;
THENCE South a distance of 301.73 feet to the POINT OF BEGINNING.
TRACT 2
METES AND BOUNDS DESCRIPTION of a 5.7700 acre tract of land being a
portion of Lots "B" & "C," Security Park Development an Addition to
the City of Lubbock, Lubbock County. Texas, being further desribed as
follows:
BEGINNING at a set concrete nail which bears Yest a distance of 890.06
feet and South a distance of 1144.06 feet from the Northeast corner of
Section 6, Block E-2. Lubbock, Lubbock County. Texas;
THENCE North a distance of 202.51 feet to a 5/8" iron rod set for an
interior of this tract;
THENCE N. 89°54'26" Y. a distance of 10.33 feet to a 5/8" iron rod set
for a corner of this tract;
THENCE N. 00°09'52" E. a distance of 183.66 feet to a concrete nail set
for a corner of this tract;
THENCE N. 53°52'22" E. a distance of 272.78 feet to a "x" found on top
of curb for a corner of this tract;
THENCE S. 36°07'38" E. a distance of 245.03 feet to a 3/8" iron rod
found for an interior corner of this tract;
THENCE East a distance of 245.02 feet to an "x" found on top of curb
for a corner of this tract;
THENCE South a distance of 339.97 feet to a concrete nail set for a
corner of this tract;
THENCE S. 45•021 27" Y. a distance of 14.13 feet to a concrete nail set
for a corner of this tract;
THENCE N. 89°55'05" W. a distance of 590.00 feet to the POINT OF
BEGINNING.

SUBJECT TO THE FOLLOWING CONDITIONS:
a. That a site plan, including building elevations showing mate-
rials, color and texture shall be submitted and approved by the
Planning and Zoning Commission prior to the issuance of a Build-
ing Permit.
b. That there will be a minimum 43-foot front setback on the West
tract (Tract 1) along Brownfield Highway, Belmont and 38th
Street.
SECTION 2. THAT violation of any provisions of this Ordinance shall
be deemed a misdemeanor punishable by a fine not to exceed One Thousand and
No/100 Dollars ($1,000.00) as provided in Section 29-31 of the Zoning Ordi-
nance of the City of Lubbock.
SECTION 3. THAT should any paragraph, sentence, clause, phrase or word
of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary is hereby authorized to cause pub-
lication of the descriptive caption of this Ordinance as an alternative
method provided by law.
