ORDINANCE NO. 9324
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP
OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 1654-A; A
ZONING CHANGE FROM C-4 LIMITED TO C-4 ZONING ON TRACTS D & G OF C. N. HODGES
ADDITION AND TRACTS OUT OF SECTION 3, BLOCK E, LUBBOCK, TEXAS; SUBJECT TO
CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING
FOR PUBLICATION.
WHEREAS, the proposed changes in zoning as hereinafter made have been
duly presented to the Planning and Zoning Commission for its recommendation
which was received by the City Council and, after due consideration, the
City Council finds that due to changed conditions, it would be expedient and
in the interest of the public health, safety and general welfare to make
those proposed changes in zoning; and
WHEREAS, all conditions precedent required by law for a valid amend-
ment to the Zoning Ordinance and Map have been fully complied with, as well
as giving notices in compliance with Section 29-29 of the Code of Ordi-
nances, City of Lubbock, Texas, as well as notices provided by Section
211.007(c), Texas Local Government Code, and notice was duly published in
the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date
of the public hearing before the City Council on such proposed amendment,
and the public hearing according to said notice was duly held in the City
Council Chamber of the Municipal Building, Lubbock, Texas, at which time
persons appeared in support of the proposal; and, after said hearing, it was
by the City Council determined that it would be in the public interest, due
to changed conditions, that the Zoning Ordinance and the Zoning Map be
amended in the manner hereinafter set forth in the body of this Ordinance
and this Ordinance having been introduced prior to first reading hereof; NOW
THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
ZONE CASE NO. 1654-A
SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and
the same are hereby amended as follows, to-wit:
A change of zoning from C-4 limited to C-4 zoning district, under
provisions of Section 29-29 of the Code of Ordinances of the City
of Lubbock, on Tracts D and G of C. N. Hodges Addition and tracts
out of Section 3, Block E, being further described as follows, City
of Lubbock, Lubbock County, Texas, located East of Avenue Q between
53rd and 54th Streets and subject to conditions.
PARCEL 1
BEGINNING at a point in the East line of Section 3, Block E, said
point being a distance of 1008.25 feet South of the Northeast corner
of Section 3, Block E, Lubbock, Lubbock County, Texas;
THENCE South a distance of 102.66 feet to a point in the Northeast
Right-of-Way line of Avenue 11Q11 ;
THENCE N. 41°22' W. along the Northeast Right-of-Way line of Avenue
11Q11 , a distance of 45.39 feet to a point;
THENCE North a distance of 69.38 feet to a point, said point being in
the Southeast Right-of-Way line of the new alignment of Avenue 11 P11 ;
THENCE around a curve to the left, said curve having a radius of
242.44 feet, a distance of 2.40 feet to a point;
THENCE around a curve to the right, said curve having a radius of
15.00 feet, a distance of 22.50 feet;
THENCE S. 58°15' E. a distance of 1.10 feet;
THENCE around a curve to the left, said curve having a radius of 70.00
feet, a distance of 7.59 feet to the PLACE OF BEGINNING.
PARCEL 2
BEING adjacent to Parcel 1 on the West and lying at the Southeast
corner of the intersection of Avenue "Q" and the new alignment of
Avenue "P";
BEGINNING at a point which is a distance of 490.62 feet South of the
Northeast corner of Lot 1, Huneke Addition, said point being the
Southeast corner of said Lot 1, Huneke Addition;
THENCE South along the West line of Parcel 1, a distance of 69.38 feet
to a point in the Northeast Right-of-Way line of Avenue "Q";
THENCE Northwesterly along the Northeast Right-of-Way line of Avenue
11Q" a distance of 35.00 feet;

THENCE around a curve to the right, said curve having a radius of
15.00 feet, a tangent distance of 15.00 feet, an arc angle of 90°, to
a point of reverse curve to the left, said curve having a radius of
242.44 feet, a tangent distance of 15.54 feet, an arc angle of
07°20'0811 , a chord distance of 31.02 feet to the PLACE OF BEGINNING.
SUBJECT TO THE FOLLOWING CONDITIONS:
1. Any use unconditionally permitted in the 11C-2A,11 "C-2 11 or 11C-3 11
Districts.
2. Agriculture implement and tractor sales and service (totally
within a building).
3. Ambulance Service.
4. Automobile body shops, outside storage limited to customer
vehicles only.
5. Automobile brake shop.
6. Automobile glass shop.
7. Automobile seat cover and upholstery shop.
8. Automobile transmission shop.
9. Automobile and recreational vehicles sales and service (may
include body and paint shop, as accessory use).
10. Barber and beauty shop supply dealer.
11. Boat and boat trailer sales and service.
12. Builders supply. All materials must be in a building.
13. Bus station.
14. Cafe supply dealer, fixtures.
15. Candy plant.
16. Canvas goods shop, tents and awnings (no manufacturing).
17. Commercial private clubs and teenage clubs.

18. Dairy supply dealer.
19. Dance hall (no mixed alcoholic beverages sales permitted).
20. Electrical equipment repairs.
21. Feed store with no grinding, packaging, or mixing of feed
permitted).
22. Frozen food lockers.
23. Bingo parlor.
24. Garage, public, repair. (Outside storage of customer automo-
biles authorized.) All work and separate parts shall be inside
a building.
24a. Garden center.
25. Gasoline service station. (Business permitted outside of build-
ing and outside displays of products permitted within three (3)
feet of the building).
26. Golf driving range. (Business permitted outside of building).
27. Hotel or motel.
28. Janitorial or cleaning service.
29. Job printing and lithographing.
30. Laboratory, chemical, general analysis.
31. Laundry, commercial
32. Linen and towel supply service.
33. Lumber yard, with no mill. All materials must be in a building.
34. Magazine agency.
35. Monument sales. (Outside display permitted).
36. Motorcycle shop, including sales, rentals and service.

37. Muffler shop.
38. Nonprofit training centers with retail sales.
39. Pest control service.
40. Print shop.
41. Produce Market.
42. Public Kennel (totally with a building).
43. Rental store. (Indoor storage only).
44. Reserved,
45. Restaurants. (Business permitted outside of building).
46. Restaurants, with the sale of alcoholic beverages as an inciden-
tal use, except that no mixed alcoholic beverage sales shall be
made or delivered to occupants in motor vehicles.
47. Road machinery sales and service (totally within a building).
48. Secondhand or used car sales lot, not including wrecking and
repairing, but including minor tuning.
49. Sign shops, limited to window lettering, painted wall signs,
banners and desk signs.
50. Store fixtures sales (no manufacturing permitted).
51. Upholstery shop -furniture.
52. Veterinary hospital (totally within a building}.
53. Wholesale house, sales office and storage -No cotton storage.
SECTION 2. THAT violation of any provisions of this Ordinance shall
be deemed a misdemeanor punishable by a fine not to exceed One Thousand and
No/100 Dollars ($1,000.00) as provided in Section 29-31 of the Zoning Ordi-
nance of the City of Lubbock.

SECTION 3. THAT should any paragraph, sentence, clause, phrase or
word of this Ordinance be declared unconstitutional or invalid for any rea-
son, the remainder of this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary is hereby authorized to cause pub-
lication of the descriptive caption of this Ordinance as an alternative
method provided by law.
AND IT IS SO ORDERED.
