ORDINANCE NO. 9329
AN ORDINANCE AMENDING SECTION 11 OF ORDINANCE NO. 8341 OF THE CITY OF
LUBBOCK, TEXAS, WITH REGARD TO THE RENTAL FEE FOR THE USE OF THE STREETS,
ALLEYS AND PUBLIC WAYS OF THE CITY OF LUBBOCK BY SOUTHWESTERN PUBLIC SER-
VICE COMPANY; PROVIDING AN EFFECTIVE DATE; PROVIDING A SAVINGS CLAUSE; AND
PROVIDING FOR PUBLICATION.
WHEREAS, Ordinance No. 8341, which is the franchise for use of the
streets, alleys and public ways of the City of Lubbock by Southwestern Pub-
lic Service Company, Section 11 provides for a rental fee of two percent
(2%); and
WHEREAS, the City of Lubbock and Southwestern Public Service Company
have mutually agreed that it would be in the public interest to increase
such rental fee to three percent (3%); NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Section 11 of Ordinance No. 8341, which grants a
franchise to Southwestern Public Service Company to use the streets, alleys
and public ways of the City of Lubbock, BE and the same is hereby amended
to provide for payment of a sum of money equal to three percent (3%) of the
annual gross receipts of the Company from its electric lighting and power
sales for consumption within the corporate limits of the City.
SECTION 2. THAT this Ordinance shall be effective on and after the
expiration of thirty (30) days from the date of last publication of this
Ordinance as provided by Chapter 1, Article II, 18 of the Charter of the
City of Lubbock, and provided a written acceptance of this Ordinance by the
franchise holder has been received.
SECTION 3. THAT the payment provided in Section 1 of this Ordinance
shall take effect as of October 1, 1989, upon the acceptance of this fran-
chise amendment.
SECTION 4. THAT the payment provided for in Section 1 of this Ordi•
nance shall revert to two percent (2%) of the annual gross receipts of the
Company from its electric lighting and power sales for consumption within
the corporate limits of the City upon receipt by the City of written notice
from the Company that it desires such reversion. The reversion shall be
effective at the beginning of the next City f.iscal year after receipt of
notice from the Company, which notice shall not be given less than sixty
(60) days prior to the beginning of any City fiscal year.
SECTION 5. THAT should any paragraph, sentence, clause, phrase or
word of this Ordinance be declared unconstitutional or ineffective for any
reason, the remainder of this Ordinance shall not be affected thereby.
SECTION 6. THAT the full text of this Ordinance shall, following
first reading of this Ordinance, be published once each week for three (3)
consecutive weeks prior to the second and final reading of this Ordinance
in a newspaper of general circulation published in the City of Lubbock, and
the expense of such publication shall be borne by the franchise holder.
