Home My WebLink AboutOrdinance - 9487-1991 - Amending Zoning Ordinance 7084 And The Official Map Of The City - 10/22/1991II LLC:js First Reading October 22, 1991 Item #6 Second Reading November 14, 1991 Item #8 ORDINANCE NO. 9487 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 2526-A; A ZONING CHANGE FROM C-2, R-2 AND R-1 TO A-2 ZONING, LIMITED TO CHURCH USES ON A TRACT OUT OF SECTION 13, BLOCK E-2, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council found that due to changed conditions, it would be expedient and in the interest of the public health, safety and general welfare to make those pro- posed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, including giv- ing notices in compliance with Section 29-29 of the Code of Ordinances, City of Lubbock, Texas, and the notices provided by the Texas Local Government Code §211.007 (Vernon, 1990), and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice, was held in the City Council Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in support of the proposal; and after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 2526-A SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map are amended as follows: A change of zoning from C-2, R-2 and R-1 to A-2 zoning district, limited to a church and church related uses under provisions of Section 29-29 of the Code of Ordinances of the City of Lubbock, on a tract out of Section 13, Block E-2, City of Lubbock, Lubbock County, Texas, located North of 98th Street and East of Indiana Avenue, subject to conditions and being further described as follows: l II METES AND BOUNDS DESCRIPTION for a tract located in Section 13, Block E-2, Lubbock, Lubbock County, Texas, being further described as follows: BEGINNING at a point which bears North approximately 1155.09 feet from the Southwest corner of Section 13, Block E-2, Lubbock, Lubbock County, Texas; THENCE East an approximate distance of 432.30 feet; THENCE North an approximate distance of 165.00 feet; THENCE East an approximate distance of 1552.40 feet; THENCE South an approximate distance of 1265.00 feet; THENCE West an approximate distance of 830.00 feet; THENCE North an approximate distance of 300.00 feet; THENCE West an approximate distance of 280.00 feet; THENCE N. 72° W. an approximate distance of 320.00 feet; THENCE West an approximate distance of 570.00 feet; THENCE North an approximate distance of 700.00 feet to the POINT OF BEGINNING; SUBJECT TO THE FOLLOWING CONDITIONS: a. That the use is limited to a church and church related uses. b. That a site plan, including building elevations showing ma- terials, color and texture, shall be submitted and approved by the Planning and Zoning Commission prior to the issuance of a building permit. Notice shall be sent to those within the two hundred {200) foot notice area for each future building phase. c. That Geneva Avenue shall remain a street with no access to the church property and no access shall be allowed to the church property from Gary Avenue between 95th Street and 97th Street. - 2 - SECTION 2. THAT violation of any provisions of this Ordinance shall 1 be deemed a misdemeanor punishable by a fine not to exceed One Thousand and lj No/100 Dollars ($1,000.00} as provided in Section 29-31(a} of the Zoning Ordi- nance of the City of lubbock. I SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. 1 SECTION 4. THAT the City Secretary is hereby authorized to cause pub- ! lication of the descriptive caption of this Ordinance as an alternative method I provided by law.
